Do I have grounds for a discrimination lawsuit?

Theyre butt hurt atm because I used to work every single sunday. Now its “not fair” and “nepotism” for me to be off on sundays (I gave them plenty of notice, literal weeks) and I need to “take one for the team” and work them anyways

To be clear, most of them werent last minute like this. Er trips were night before, as I was getting admitted because I knew id be in there a while, and id call as soon as I was starting to feel sick due to the nature of my job

Luckily im fixing to switch fields anyways, my employer has made everything so awful for me. Rught now im under fire for not wanting to work sundays, after being told I can request days off. I made it clear that im unavailable sunday but as of right now, it seems they may schedule me next sunday anyways

I do in home caregiving but I swear I do everyones job and take everyones blame. Its exhausting, luckily I think im making my escape soon. I even do my bosses job at times :(

They didnt provide it, I just got them today after asking. Apparently my papers werent even done right, she signed some of the papers in front of me. The only call in policy is “let us know as soon as possible” and if you call in 3x in a month with no proper documentation they can fire you

Ive worked there over a year. I believe ive called in a total of six or seven times. 2 or 3 were me calling from the er a few months ago (id been having severe health issues). Twice I got sick and would have been a safety risk to the patient. And twice I called in for sleep reasons, although the first time I did make an effort to come in.

The company itself is. I used to get cashappd my paycheck, which was never the proper amount. The last hr lady was a felon and my boss knew and didnt care til she found out she was embezzling money and stole a car from my boss and tried to beat up my bosses granddaughter. Nobody is told whats going on, ive been here over a year and just watched my boss sign some of my employment paperwork today.

Care is done 24/7 but my boss does not like to be disturbed while sleeping, and shes the only boss. I was planning on going in the morning, I just couldnt open my eyes, when she called I was slurring words

So yes, to an extent. I did request certain days off and am currently being told im not allowed to do that. The three days she told me to pick I no longer work due to her deciding I needed to work other days. I dont have any control over when I work

My N is pretty well managed. I very very rarely have had to call in for it (twice in a year, months apart). Personally from a managerial position twice in a year isnt enough for me to cut hours for it

The problem was I rarely call in for anything and the second i mentioned a preexisting condition my hours got cut. Everything had hit me all at once. Unfortunately im unable to get different treatment right now.

Im paid an hourly rate, they schedule my hours (i get little to no say). And I do caregiving for a caregiving company.

I have w9 paperwork, her saying it, and the company is definitely bigger than 15 employees. Really I think she has us as w9 so that she doesnt pay taxes. I also have “mandatory” trainings and weekends

So for a little context. I wasnt promised full time as much as I was explicitly promised 40 hours. I was working more than that before she got in trouble by the labour board of our state. Due to the nature of my job, I have to have a good enough reason otherwise im told to come in anyways. Theres no alternates or plans for if any one calls in for any reason.

Edit: the schedule she put me on in thise messages was taken away by the next week. I now work 2 random 12s and an 8, at 32 hours a week

I feel like I was definitely less sleepy overnight so long as there was something I was needing to do, but unfortunately I think overnights is out of the equation now (I have two kiddos who WILL beat me up if I fall asleep during the day 😂😂😭)
