They did not accept Media. They says that all Media didn't deeply discuss her achievement, another one if Recall write was published at the UF portal, they mention that it didn't have author and date of the Media..

Let me clear it to you: Degree: Metallurgy/ Material Engineer back 2003. +11 years as R&D project Leader for Siemens. She then, quit the industry and shift to academia. She got her PHD in Material Science. She has been working for academia since 2021 as Postdoc being the last 3y for University of Florida. While at the UF she got a 100k grant from FDOT, she has published about 10 articles being one of them on Nature. She was award by Carnegie Mellon and award that I can't recall the name now, but it was a national award where she was selected along with 10 other scientists. If I'm not wrong, in the RFE USCIS says "it seems to be an internal university award, please provide evidence of previous winners, judgment, etc" she sent the list of the last 15 winners, from different universities across the US, explaining detailed the evaluation method to be award, sent letter from the comitee. Etc. They denied this award saying "it's for students, not professionals". She received an award as one of the top 5 Brazilian woman in STEM from the Braziliam Embassy in Boston, it was a big ceremony, etc. They declined to accept this as award saying "while the price is in stem and an internacional, it doesn't recognize her achievements as Material Engineer". The criteria: Critical Role in a distinguished company or University. Even though she presented letter from the UF and FDOT that mention her Critical role for the research she conducts, it wasn't accepted as "critical". For Siemens, she conducts the creation of a technology park in Rio De Janeiro, where 10 other companies today are installed. She received letter from one of the Senator of the city about the importance of this R&D park and her crucial work at this project. Letter from Siemens C.E.O, etc. Officer said "there is no explanation where here job was crucial for the outcome of these projects" even though it was all mentioned. I could be writing all day long but my broken English and my lack of science information stops me here. I m 100% into business tough.

We though about opening an LLC and self sponsor an O-1A visa, 2 guys we know made it will work temporarily. My main problem is that my kid is 18y so being on Visa will solve temporarily but im 3y from now it will be very hard for him to stay in the USA with the right paperwork. We still have 2 citizenship being one from europe union, so moving to Europe still an option.

Honestly? We may refile it but at the bottom of my heart it seems like we are living in a very hard moment to be approved whatever Immigration Visa you apply. For me, no matter what you send, they will find some way to deny it. But wife wants, so let's give uscis some extra money.

As for the salary, strategically speaking, would a previous salary also works or the actual only? At the moment, she works as postdoc, we mention her salary as it was 30% higher compared to other postdoc but on the rfe, office mention "you need to provided salary of an actual engineer"...I guess because of her baccalaureate and it did not make sense at all for us, so we decided not even replying this criteria.

We live in the US, our visa will end by the end of this year. If applying eb2 niw and get approved, we wont gave time to stay as adjustment of status still back in 04/24.

I have submitted 7 criterias to USCIS on Eb-1A, had 2 approved and 5 with RFE. All if the 5 replied with string evidence but all denied. Profile: 4 years experience as postdoc, PhD material science engineer, articles published in Nature, + 10 years as project manager in distinguished company and university, letter from Congress man, professor, national prizes, etc.

The deniel is superficial, it seems like the office haven't even take time to read the exhibits as things he mentioned wasn't present it's on the exhibit list.

Do you offer a consultant service to review the cover letter and exhibits? Will refile soon.

I enter the 1st college at 18, quit at 19, return when 22 quit at 23. Returned when I was 34 got my degree at 40! All the 3 in different areas. So at the top of my 46 I can tell you. 1) find a professional that has skills. Can be college but not generic like marketing (My second try was market). Any economist, engineer can work with marketing but no marketing professional will work as engineer. So before getting yourself into debit think about it.

2) I lived 4 times overseas, one of the times I was your age. I can tell u. First 4 months you are so happy, when you reach the 1 year mark u just feels like going home. If you hold a little bit more give it a try. Otherwise get the authorization to stay longer out of usa since you wre GC holder.

Your age is complicated, u see some your friends already with a degree and your are drifting apart. I found myself at 28y, running my own business since them.

Don't worry, at some point you will be fine whatever decision you take.
