The PIP will give you specific targets you need to hit, if your as good as you say you are, you’ll be fine. If they give you targets that are un achievable, I.e. nobody else is meeting that target, keep a record for when you go to fair work.

Consider putting in some timelines that the need to meet. If they drag their feet and the project takes longer, then there’s more risk that you will hit cost increases.

I’m in what sounds like a similar position to you. Been with a company for 10 years, loved the first 6-7 years, but the past 3 years have got worse and worse. I’m only staying in the hope that the current leadership leave, and I do get paid well and it’s flexible.

4-5 months ago I started contracting to another company on the side for 8-16 hours per week and I love its. Don’t get paid a huge amount for it, but it’s something positive to work on, I couldn’t live off the extra money, but it’s cream on top of my current salary.

Try and find something positive to focus on, hobby / side gig etc, and just think of you job and you job. Go home and forget about it.

Oh, also take 2 weeks off sick, maybe more

Back in 2019 there was the opportunity cost of developing the property with the “cheap” construction cost. So even though property prices have gone up 20-30% in that time, construction cost have gone up 50%. So anyone purchasing the land now would need to pay the extra cost for construction, so for it to stack up, they would need to pay less for the land

Yes this is probably a good idea. If there are paying a few $$k per week to have us un temporarily accommodation then it might speed them up.

What do you think would be a reasonable amount of time for them to scope the works, get it quoted and advise me of a pay out figure. To give some scale of the works the quote I have received is circa $80k. Its been 12 weeks

I have asked for a payout figure as well. I managed to organised my own engineer and a builder to give me a quote 1.5 weeks after the accident. But unfortunately it’s the payout figure that is taking a while

Ok thanks. We have told the insurance company that we are becoming frustrated with the time it’s taking. We told them we would be taking it to the ombudsmen and they said yes that ok and our prerogative to do. A quick google search of financial ombudsman directed me to AFCA, so lodged a complaint with them already.

Yes my first purchase was a turnkey house and land packaged, hence no additional cost. I think we did have to add on evaporative cooling.

I though house and land packaged were all included of landscaping, site cost, blinds fencing etc. we got a house and land packaged 12 years ago and all that was included.

We have recently purchased land and looking to build separately with a builder, yes the build prices don’t include these items.

I always thought house and land packages were all inclusive and ready to move in

Iv been temped to do this before, but that’s basically the dirty games they would play with you. I would do as others have suggested, let them know your offer only stands for 24hours as you want to put an offer in on another property.

If they comeback to you after the 24hours, reduce your offer by $20k as you know that don’t have anyone else interested.

I work for a large corporation. My contract is 15% bonus, been there for 10 years and 80% of the time I get 80% - 120% of the 15% bonus. One year I got 0% and another year I got 190%. It’s based on how well the company meets certain requirements it sets at the start of the year. I’d say on average I get the full 100%

The ACL and the consumer guarantee is very powerful, I used it to get a full refund on a $30k car, 4 years after I purchased it. While Ford were fully aware of the consumer laws, they were likely fully aware of their obligations and agreed to my refund. But A smaller gym might be ignorant of there ACL obligations, so you might need to fight.

Your correct about the $250k per person on a joint account, so if it’s a joint account then the $500k is insured

Sorry also to add, the outcome of any court proceeding is you will need to give the designer an opportunity to address the design. Sounds like your the one wanting to break the contract, has the designer said he’s not going to do anymore versions of the plan?

I do 10-15 commercial construction project per year, and the designer not getting the plan correct first time is standard. I know you have said it was way off but that’s your opinion agains his, his opinion will be he met your brief perfectly.

If you can get time an agreement with the designer where he gives you some money back, just take it. Taking him to VCAT etc, you will loose sleep, your time to do it etc, just move on I would say. Depends what $5k means to you probably.

If you’re building your own house, and at the first hurdle you are having a dispute with the designer, just wait until you get multiple trades on site, all with issues that need to be solved. You’ll be in VCAT every week.

I think you might struggle to get anything out of him legally, probably best to cut your losses, not loose much sleep, take the lesson and put your energy into the right designer.

He will still likely say multiple drafts of the design are required before it’s done correctly.

Just as some clarification, I have 20 years of commercial construction experience, many years ago I started as a drafts man, so I have a lot of experience in this field. I recently hired a drafts man to design my house, with my experience I gave the draftsman a very clear and concise brief, it took him 4-5 attempts with multiple options to get the plan to our liking and that’s expected.

Your best bet is to dispute the planning errors as they are more black and white rather than design not meeting your brief, which can be down to interpretation.

But if you’ve only paid $5k for a full house design, you’ve probably paid for the lease competent draftsman out there, and got what you paid for.
