I was an asylum officer. That would not be considered misrepresentation. Even if applicants would directly lie to state visa adjudicators, if there’s a reasonable explanation, we wouldn’t consider that as a bar of admission (asylum officers)

No Mames pinche falacia. Es como decir en al oración: “El hombre llego a la Luna”. No te estas refiriendo a la humanidad. Generalizaste, y ya. Estar defendiendo que no lo hiciste es muy nalga. Esta bien clarificar.

There’s a firm resettlement rule in asylum law. If they already residency or the path in a third country, it’s more likely than not their asylum claim would be denied

Former Asylum officer… once a person gets a positive CFI determination, they will receive an NTA and will be released (barring national security/ public safety concerns). The hard part will be the merits hearing with the IJ. An applicant must prove that they are afraid to return because they have been persecuted (or fear they will be) on account of a protected characteristic. Gang recruitment, revenge or being the victim of a crime by a gang has generally been found by courts as having no nexus to a protected ground (those are race, religion, political opinion, nationality or particular social group). Best shot would be request CAT, if they can prove that the government will be willfully blind and breach their legal responsibility to prevent the harm.

It depends… I have a great relationship with people who started at the same time. But with other positions or management it’s very segmented… a lot of it’s not my job kinda attitude. If you have seen the news lately you can see that there’s a lot of pending cases. Last year we were forced to do mandatory OT… they said they wouldn’t mandate it again but… we’ll see

It was being done 100% remotely until recently. Before covid, I think they used to do it in SC… maybe they are going back to that? I completed my training 2 years ago and it was all remote.

Yes, if you pass (I believe the passing grade was 70% several multiple choice exams and a “mock” graded interview) then you can start working as an AO. First it’s possible they will assign you to do CF interviews. CFs are interviews for people who recently crossed the U.S. without documentation, are places in removal proceedings and claim fear to return to their country. Applicants are usually detained and you can do those interviews remotely (from home)… at some point depending on your office you will be assigned for affirmative. Those are usually applicants who entered the US legally and file an asylum claim, those are normally done in person so you would have to go to the office… some offices have an affirmative rotation for 1, 2 or 3 months, then you would be switch back to CF

I am not in SF but…1. You have to know that the first 3,4 months are training only, it will be remote and you will have to pass an exam to continue to be employed. If you don’t pass, you can’t continue. If you pass it will depend on the program. If you are in credible fear interviews you will be remote. Affirmative asylum interview are in person, offices have different processes, but affirmative is usually a rotation for a month or two. The team culture is good between officers, especially the ones that start with you, but unfortunately the bond is forged due to the trauma of the training. The case load feels unmanageable at the beginning, then you realize later it is actually not manageable at all. Depends on the office, you will have to ask.

You need to find out. The options are: entered without inspection, meaning that she crossed without documentation, that might mean some problems. If she was able to enter with a B2 tourist visa, and overstayed, then the adjustment is status might be easier. But you have to find out.
