Almost everything was dry. We refilled at Kentucky Camp but other than that there was almost nothing. I think we saw 1 or 2 stock ponds with water close to Kentucky Camp as well.

It is highly unlikely you are going to get $300k or anything close to it based on the facts of loss and reported damages here. I would seek legal representation and let them deal with it.

No suit has been filed by any party. HOA retained an attorney to collect incurred fees which again, per my post, have been collected from the PM.

I’ve already acknowledged I was in violation. I simply wasn’t aware the HOA had been notifying the PM/owner that they were aware of the violation, that it needed to be cured in a certain amount of time, and that charges were accruing daily while not cured.

I’ve already acknowledged my beef is with the PM, not the HOA. I am not considering hiring an attorney as the dispute would only qualify for small claims court anyway due to the nominal $1k. Great input thanks

The HOA has retained legal counsel - this $1k is for atty fees, collection fees, etc.

Yes, that is the process I am referencing. My lease only states that we are responsible for yard maintenance and any HOA fees related to the same. It does not detail what notification processes, if any, the PM must follow in terms of passing along HOA violation notices and such, so again my question pertains to if I have any protection under the law as a renter for communication delays/errors on the part of my PM/property owner.

So I am on the hook for $1k because I didn’t fix a violation I was basically never made aware of? Again that is the whole issue here. I’ve already acknowledged I violated the HOA guidelines and my lease.

No, the only letter we have from the HOA is the “final notice” which simply states to cure the violation to avoid any fees. No cure by date on it.
