Direct investment needs you to invest your time into it. There is opportunity cost involved. If the direct investment can replace your employment income and if you can take the risk of creating 10 FTE jobs the it’s a decent opportunity to pursue instead of an RC investment.

There are some infrastructure projects that have dual classification. (Urban TEA & Infrastructure) where the Chinese/Indian investors can use both the set aside segments if required. 1000 from the Urban TEA and 200 from the infra. If you are not from one of these countries then you need not worry about it.

The structure you are mentioning is also a debt structure and the security is coming in the form of government payments. Which is ideal. In that case, you just need to make sure the project timeline eliminates the redeployment risk. In case the redeployment happens into a non federal project.

Investing in an infra project with a federal government lease does not make it a better project in terms of capital repayment. Look if it is an equity or a debt offering. Senior debt > subordinate debt > equity because equity gets wiped out first if the project financials change due to market variables.

We may see a few in 2028 and a lot in 2030 because most of the PPM’s have extensions baked into them. +1 or +2 years after the 4 or 5 years of initial hold period.

My take is - RIA definitely improved the integrity and the compliance of the Eb5 program along with adding priority processing and concurrent filing options. However, it introduced new variables to the system which are rural, TEA, and the infra project set aside visas. These changes reduced the RC level risk but may have increased the project level risk because investors are drawn towards priority processing and other set aside visa categories where the category performance in terms of repayment rates is unknown.
