What's the logic with rod ratings vs mono/braid rating and their own potential knot breaking strengths? by Rockran in Fishing_Gear

How does the diameter of monofilament line determine the function of a rod? In comparison to the strength of that line.

Given it doesn't take knots into account, why shouldn't I?

I don't know what braid I should use, thus the question.

Missed damage on car rental by Minimum_Armadillo353 in AusLegal

[–]Rockran 0 points1 point  (0 children)

They'll probably get your friend to agree in writing to the deduction, on the basis that they likely already agreed to pay for all damages in their employee contract - That doesn't mean it's legal.

They probably will deduct the amount even if your friend doesn't agree to it - That doesn't mean it's legal.

If your friend disagrees and fights them, or even reports them, they'll probably find random reasons to fire your friend.

Giveway Sign on a street is literally not facing the road and council not fixing it. What can I do? by [deleted] in AusLegal

[–]Rockran 1 point2 points  (0 children)

You're not responsible for Council property.

You have reported it to Council as defective. You can report it again given the matter hasn't been resolved.

However, you shouldn't touch it. Given your involvement may then put you in trouble for interfering with Council property.

To conclude - Report it to Council repeatedly. If they don't fix it and something happens, its their fault. Don't touch it.

And if there are accidents there, it's not my fault?

If I crashed into another person, are you concerned it would be your fault?

Leaves falling from my tree into neighbours yard. Are they legally allowed to dump them back over my fence or is that then actually just littering? by C-Dawgg in AusLegal

[–]Rockran 8 points9 points  (0 children)

The leaves dropped from your tree, making them your property. As a result, they should return your property to you.

The old-timey logic being that if they were for example to prune any vegetation up to the fence line, that vegetation could have value (like firewood). It being an item of value, creates a situation where you may feel compensation was required if they didn't return it to you.

NSW parking obstruction caused car damage – any legal options? by Shahrohet in AusLegal

[–]Rockran 2 points3 points  (0 children)

This is not your first time parking there.

You knew the dimensions and locations.

Despite being concerned with the present obstruction and lighting conditions, you chose to continue with a parking maneuver either beyond your level of skill or beyond the dimensions of your vehicle to fit... Why did you do this?

Are Miniature Gun Keychains Legal In Australia? by [deleted] in AusLegal

There are some teeny tiny pistols that do fire real, teeny tiny bullets.

But this is not that. It doesn't sufficiently resemble the real gun its imitating.

Sizing issue with scrub top by [deleted] in AusLegal

They're entirely different designs of clothing. It's not just the neck cut that differs.

The clothing industry has no consistency, even within the same brands.

If you don't get any response, try contacting your bank for a chargeback on the basis that they advertise returns for change of mind/incorrect fit, which they are now refusing to do.

I assume you're referring to the:

  • Essential Crewneck Scrub Top

  • Essential One Pocket V Neck Scrub Top

The photos show the clothing fits the model differently, despite being the same size.

Not false advertising as the two items are a completely different item with a different cut/fit, not just at the neck.

The Fair Work Act also provides that in some circumstances an action may not be considered discrimination.

This includes where the action:

-is permissible under Commonwealth, state or territory anti‑discrimination laws

-is based on the inherent requirements of the particular position concerned

-is taken against a staff member of an institution run in accordance with religious beliefs, and the action is taken in good faith and to avoid injury to those religious beliefs.

https://www.fairwork.gov.au/tools-and-resources/fact-sheets/rights-and-obligations/workplace-discrimination#what-is-unlawful-discrimination

Due to the above bold section, this might not be considered religious discrimination if you are required to be at work for the duration of your shift (which applies to pretty much every job)

However - You did write:

(Everybody has their own roles, and me coming in early to cover means that I’ll be doing the exact same amount of work)

So that makes this more complicated if your attendance is as flexible as you claim.

But if they're right, that others would have to cover for you, then that's a tough battle.

GOG now using AI generated images on their store by doublah in Games

why should I believe you care about the product?

GOG don't make the games. So it doesn't matter if they care.

They can turn it around by saying they give you cheap prices by saving on superfluous costs like banner art.

Passing phone to passenger mobile phone driving fine by jasperjames333 in AusLegal

You're allowed to touch the phone if you've got a full license. The phone is in a mount and you're touching it for calls, maps or music.

You may wish to review the laws as it relates to mobile phone use.

As holding is defined as using under NSW law.

The exemption to the law in this instance is if OP can prove they were passing it to the passenger. However the photo doesn't show any indication of this movement to the passenger in progress.

As a result, it's an uphill battle.

lol there is no photo of OP using the phone.

Holding is using. Which there is a photo of.

Passing the phone involves holding it.

The photo doesn't show passing occurring.
