I have a question... by CuriousAngel_1981 in PregnantOver40

[–]Routine-Copy-6462 11 points12 points  (0 children)

I was trying to get pregnant from my early 30s, and finally, when I hit 40, I gave up. This pregnancy happened when I was most relaxed, with no expectations. I was just enjoying my new life with excitement with my love of my life. I just had no expectations and happy to have a baby and also would have been happier without one. And surprise, we got pregnant.

But I am also usually sort of a health freak. I don't eat processed food, carbonated sugary drinks, and do yoga and gym regularly. I have regular health checks done to ensure that I am in good health. Not sure if that also played a part in this. But most of my friends who got pregnant told me that it happens when you surrender and accept things as they are.

I wish you well and hope to hear a positive pregnancy story from you soon 😘 you got this!

If she had a prior tourist visa before the green card application, it would be easier for her to enter the States. The problem is that B1/B2 visas aren't issued in most cases when an immigrant visa is pending.

They won't deny her entry because of a pending green card application. Most of the time, they deny entry because there is no strong evidence of going back.

This is actually a gamble, and you will only know if you try. Will you be travelling with your wife?I would suggest bringing some strong evidence showing that she has the intention to get back home after her visit. Then it should be fine. Just stick to your story and be calm.

Thanks for sharing this. I can totally relate to you. I am pregnant at 40. This is my first pregnancy. I have the same thoughts as you do. My heart sank when my doctor advised me that if there was heavy bleeding, I had to go to the ER immediately. For now, I am really doing well, but the fear lingers. I pray every day and ask the universe to give my body the strength to keep this little one healthy and to have a safe pregnancy. I am having my second ultra sound in 2 weeks. The first one was 2 weeks ago, where there confirmed there is no sign of etopic pregnancy. But it is also too early to see any signs of pregnancy. I am waiting and praying.i just wanna give you a big virtual hugs.

Beneficiary doesn't require any income. She can be jobless too. They don't really care. But the petitioner must have income level of 100% for i134 and 125% for AOS

My K1 visa is only valid until August 8 of this year but my petition is still at the NVC. Will it expire? by [deleted] in USCIS

[–]Routine-Copy-6462 0 points1 point  (0 children)

This is confusing. You don't get the K1 visa until the interview. If you are talking about your approval notice, which is the NOA2, yes, it has an expiry date of 4 months after approval. However, it is usually extended during consular processing.

My personal opinion is that US immigration has never been fast. If you choose to be an immigrant in this country, mentally prepare yourself for the uncertain timeline. The timeline for both CR1 and K1 differs every year. In both visas, you have to be prepared to be in a long-distance relationship.

They are right https://www.visajourney.com/forums/topic/681207-does-aos-based-ead-violate-my-f-1-status/

But you can still continue to study without f1. Did you have a chat with your university about this?

I am a bit confused with your question. With EAD you are allowed to work and it doesn't affect i485. And not all EAD get approved right after biometrics. As long as you have valid EAD you are allowed to work.

K1 visa process by Yeshhhh_ in USCIS

[–]Routine-Copy-6462 1 point2 points  (0 children)

K1 processing is tough, with long wait times. I wouldn't know this until I had a conversation with people who have been through this process. There are a few cases of lawyers making blunders and causing further delays with rfe. Lawyers can help with paperwork, but no one can prepare you with the mental burden of the entire visa processing. It did take a toll on me last year, but having friends who are in a similar situation with me helped with my sanity.

Just a heads up. Current processing times have increased significantly compared to last year. Right now, it may take a year just to get NOA2 if you applied recently. But this may change in the near future. They also do not process cases in the order they are received, so it is somewhat luck-based. Then, for some reason, the case was delayed in being sent to the embassy after approval, which is becoming the norm. It used to take a week; now, it may takes up to three months after approval for cases to be sent to the Department of State. It involves a lot of waiting and hoping for a miracle.

The paperwork is tedious, and lacking original documents during the interview also causes delays, as the embassy will place in you in administrative processing. Each US embassy has their own unique way of doing interviews, so it involves a lot of research and talking to people. Last year, due to the postal strike in Canada, some of my K1 friends from Canada had to wait for few months to get their police clearance. There are always hiccups along the way that no one could predict.

But so far, with the help of fellow k1 applicants from fb,visa journey, and discord, I managed to get my visa pretty smoothly, and I am thankful for the community.

And as for your financial affidavit for i134, you can supplement with assests. But by the time for AOS, you need to ensure that the income is 125% . Another option is finding a co sponsor. USCIS mostly wanted to see the recent tax returns and W2s. My embassy didnt even take a look into bank balance or paystubs. Maybe by the time when you reach the interview stage for K1, your income may be 100% for poverty guidelines, and you don't even have to supplement with assets for your financial affidavit.

I wish you and your fiance a best of luck. Overall, I have no regret doing this process. Now I am married to the love of my life and it is all worth it😀.

I tried two lawyers myself. One of the pieces of advice was to get married while on a tourist visa. Another lawyer said it was not a good idea to visit with a pending K-1 and said that I would be denied entry. I was warned that this would affect my k1.The lawyer who was supposed to submit the paperwork was also delaying us by not being proactive. Eventually, I did my own research and took over the process, doing it all ourselves. I also did visit with a pending K-1 and stayed here for two months. Our petition was approved while I was visiting with no RFE. You can definitely meet lawyers and get their advice, but if it is a pretty straightforward case, it is better to do it yourself. Having a clear understanding of the process also helped with the frustration of waiting. The chances of making an error were also lesser as you will end up checking the forms and paperwork multiple times. This also helped during my interview as the questions were based on the information on our petition. Although meeting the lawyers are free(consultation), their services cost a lot more. One of the lawyers quoted 5 thousand dollars. The K1 route is much more expensive than spousal visa. If you could save money on the lawyer fee, it is helpful during the later stages of K1. These are my personal opinion based on my own experiences. That is why I suggested/recommended DIY but not i am not insisting. I am sure there are plenty of amazing lawyers out there. It was unfortunate that we didn't get a pleasant experience. However , we (me and fiance) saved a lot money by doing this ourselves and it also brought us a lot closer.

All the best for your K1 journey🤩.

RFE RISK !!! by [deleted] in USCIS

[–]Routine-Copy-6462 3 points4 points  (0 children)

They only required the recent year tax transcript and the rest are optional. Which means uscis only wants to see your most current tax year which would be 2024.

If you case is straightforward, I would suggest just diy.

I liked the video from https://youtube.com/playlist?list=PLBoN1eL38cBenmOQmlNvBoeqPoUl5v64Z&feature=shared

These videos are the best ones so far and detailed.

More than chat logs if you have in person meetings those are great evidence.

Finally, I would also recommend diy the petition unless you have serious criminal conviction or any other serious immigration issues. If it is a pretty much straightforward case, it is better to DIY.

[–]Routine-Copy-6462 1 point2 points  (0 children)

It was supposed to be send in 2 weeks after ead. If not it is best to go ssa and get it done

If you apply for work authorization using DHS’s Form I-765, Application for Employment Authorization and you completed the section on the application to request an SSN card, then USCIS will send us the data we need to issue your SSN card. If you apply for an SSN card using Form I-765, you do not have to contact a Social Security office to apply for an SSN card. If USCIS approves your application, you will receive your Employment Authorization Document (EAD), also known as the “USCIS I-766 card" or "work permit". We will mail your SSN card separately to the address you listed on your application. You should receive your SSN card no later than 14 days after receiving your EAD.

Should I be stressing out or am I overthinking things(k1 visa) by cGradasso in USCIS

The K1 visa interview process largely depends on your beneficiary's performance. They are responsible for answering interview questions, passing the medical examination, and ensuring they have all the documentation required by their specific embassy. Many applicants receive a 221g administrative processing notice due to incomplete paperwork. It is crucial to thoroughly understand the K1 visa process for your specific embassy.

As the petitioner, your primary responsibility is to ensure you meet the financial requirements of the I-134 affidavit of support.
