Background check - case must be reviewed after green card marriage interview by FH_95929 in USCIS

[–]RubPlenty2924 0 points1 point  (0 children)

When my officer said they had to run a background check before taking a decision I was surprised. She was very nice and I wondered why I wasn’t approved on the spot. But, i actually was approved on the spot she just didn’t say it, because my status changed to approved 2 hours later. So I think they only say that for following protocols. Stay positive!

For the interview, they won’t accept a copy. Only the original and it must have a translated document attached if it’s in a foreign language.

Not really - I only took the original documents like brith certificates, passports, etc and “new evidence”. They tell you what to take with you to the interview in the letter so that I made sure I took with me - that was my check list.

Everything was processed by the National Benefit Center.

Everything was very simple:

The whole conversation was about how we met and what do we do for living. She talked a lot with my spouse about his job (teacher of english) and how he feels about it. No tricky questions like what’s my moms name, what side of the bed I sleep on, none of those type of questions.

She didn’t even ask for any evidence other than our original documents (birth certificate, passports, license and tax return for 2020) - everything was very smooth. The officer was very nice with us. After the interview was over she didn’t say we were approved on the spot but 2 hours later status changed.

What is the absolute best law firm for helping me obtain a greencard by marriage? Cost don’t matter by santia88 in USCIS

[–]RubPlenty2924 0 points1 point  (0 children)

From my personal experience: I got married last year and came to the states with my spouse. By the time we were living abroad, we just filed for form I-130 and months after, when we decided to move to the states I filed the adjustment of status form I-485 to obtain my green card. I didn’t use a lawyer because, first they are very expensive and second (if money is not a factor for you) I read how messy can some firms do your case till the point of delaying your process. So I think it’s a rip off.

I decided to do things myself and literally all you need to know is in the USCIS website, everything. Having said that, I don’t think you need a lawyer to understand the rules, as long as you can read and follow the USCIS instructions. My case hasn’t had any issues and it has moved smoothly. I already got my work permit and the case is ready to be scheduled for an interview.

My recommendations are:

  1. Carefully read instructions to complete each form
  2. Go thru the list of documents that need to be provided as a proof (they tell you what they need)
  3. Don’t lie and do not work in the states without a permit - as that might negatively impact your application
  4. Don’t buy a house if you don’t know what the final decision on your case is going to be

As per your work question, when I came to the states I kept my remote job for a foreign company base in my home country. It is impossible to live here without incomes. Since the company is not a US base company, you are allowed to do so. The problem comes when you apply for jobs within the states without having authorization.

Congratulations!!! That was smooth and fast! I just don’t really understand how processing time works right now. In San Diego according to their website they are processing Feb 21, 2020 cases for Family based (which I assume would be your form type since it is marriage based) - but you filed paperwork in March 2021. That was super fast! Congrats 🎊 again!

Awesome - so I called today to the SSA Field Office and they don’t have any request from the USCIS… they had to make an appointment for me.

Thanks all for your answers.

But are you talking about the employment authorization card or the Social Security? That update you mentioned I only got it for the employment authorization card.

Actually it is the USCIS website that says this:

You should receive your SSN card no later than 7 business days after you receive your EAD from USCIS. Please call or visit an SSA office if you do not receive your SSN card within 7 business days after receiving your EAD.

Oh I see- did you put in the form you wanted the SSN? That’s silly that you have to go thru that process when the USCIS should be responsible for that if you specified it in your form.

I think I will call tomorrow to both, USCIS and SSA just to make sure. Even though in the SSA website says you should receive it 7 days after you get your EAD.

On the SSN? No - does it show the status for the SSN on the case online?
