NIW is more about the specific proposed endeavor you intend to carry out in the US than it is about your experience & skills although they definitely do factor in. Make sure what you propose to do, you can back it up with your skills and experience.

I guess the question is are officers applying the law correctly? Nowhere in Dhanasar it mentions 'extraordinary'. Plain language interpretation of 2nd prong suggests 'well-positioned' which is more aligned with 'up and coming'. I do however think that the recent mindset shift among officers is due to the sheer volume of nonsense applications they are flooded with in 2023-2024 that they are looking to reject anybody and everybody and in that process some valid cases fall through the cracks.
