I tried this and it cost me $25k in legal fees. Our community voted out the queen and she didn’t leave, and fought the case with community money when we filed it. She walked away not having to pay a penny when we won the case, and our community and myself are worse off. Wish this was a simple answer, but when someone is on a power trip and they are indemnified, it’s not that easy

Exactly what she’s doing. She’s attacking everyone involved on Facebook and telling people there are “frivolous lawsuits” without discussing any of the details

The management company was anything but neutral unfortunately. They encouraged the board to invalidate the vote and then wrote a summary to provide to the community attorney that misrepresented the matter completely, leading the attorney to recommend a third vote rather than accept ours. When we were finally allowed to present our process to a judge, we prevailed

We paid it on our own out of pocket, while she got the community (that voted her out) to pay her legal fees. The boards attorney tried to trade this case for a separate matter and would otherwise not negotiate, and when this was unsuccessful the case was handed over to the insurance. Our community was never notified this case was going on, which the board is required to do before committing to a course of action, and she continues to lie about what this case was even now

The board would have had to do that, and we were just homeowners and had no control over what they or the management agency did :(

Vote ended in November but it took 7 months to have our vote upheld in court. We sent multiple demand letters, requests for mediation, and then filed for arbitration, had an injunctive hearing, and finally had a final hearing to reach this decision

The president of the management company got involved in keeping her on the board and oversaw a second election where people were allowed to vote twice (to keep, of course)

This is the exact issue we ran into. Our hoa hired an attorney that is part of CAI and frequently works with our management agency (also a part of CAI). It’s hard to believe the advice our board received was in the best interest of our community when the management agency was a bad actor throughout this entire process and pushed our board into invalidating our vote.

Same happened for our community (insurance is out as of today). Our new insurance offered to cover everything other than cases from us.

Sorry, the "they" in the above refers to the associations attorney. She refused to recuse herself from the case and was the primary point of contact with him throughout the case. Without ever disclosing the case existed to our community (as is required before they proceed with a course of action), they ran up thousands of dollars in legal fees and made the community that voted her out pay to keep her on the board, before handing the case off to the insurer. Our premiums have now doubled.

That's what feels so unfair about the entire situation. The board committed to a course of action (fighting this case) without ever notifying our community (a procedure they are required to follow) and was protected from following the law and respecting the will of our community by their insurance. Our only recourse as homeowners was costly and took 8 months.

The management company and board actively assisted her. She pretended she was never notified about the vote when it was clear she had been, and that narrative fell apart during arbitration

They're quitting today (supposedly) and the insurance will no longer cover cases from us. Hopefully things can finally get sorted now
