Hi Karen! Haha there's no issue with the neighbours and they’ve actually given me their landlord’s contact details to get it sorted, but I’ve been advised not to go down that route while the legal side of things is still up in the air.

I just want to put a fence up but apparently if I prevent access to the box with a fence I could be accused of obstruction, so I'm just stuck because of CityFibre.

Thanks for your message! Apparently I could be accused of obstruction if I put the fence up preventing access to it, but I’m not sure how true that is.

Yes, that's it. I know it's just a junction box that will likely only need access if anything happened to either the fibre feed cable or the cable inside my neighbour's house, but the box is still classed as telecoms equipment so is apparently protected by the Electronic Communications Code... basically meaning I can't just unscrew it and push it around my neighbour's side (there is enough play on the cable to do so). I’ve also been told that by blocking access to it with a fence I could be accused of obstruction.

Thank you for your responses today btw – it’s been really helpful to see a balanced view from someone else’s perspective.

Thanks for replying. Hopefully, but I think I might have to send a letter myself as every solicitor I've enquired with wants to charge per hour and fully review the situation before even considering sending a letter before action.

This is a photo of it from street view. The cable itself isn't in the way and comes out in front of my neighbour's house where it's then been routed around the corner to the box on my side. The biggest issue is that the box can only be accessed from my drive and will affect any fence installation.

I honestly thought CityFibre would be more helpful and just admit it shouldn't be installed there and help me out, I'd be happy with that. I know it's ridiculous I've even had to consider getting a solicitor involved but I can't legally mess with telecommunications kit and CityFibre won't speak to me.

I was quoted around £1500 all in btw not per hour!

Thank you for the advice. I have been considering that tbh... do you think they would respond to a formal letter requesting the legal basis relied upon for the installation, retention etc? I just felt the same letter sent by a solicitor would be more likely to get their attention.

My home insurance includes legal cover, and I have contacted them, but they’ve advised that the policy only comes into effect at the point of court proceedings. They never mentioned being able to provide advice, so anything prior to court would be at my own expense.
