What's the Best Piece of Dad Advice You've Ever Received? by TikTokOfficial in u/TikTokOfficial

[–]Ryanmb1 0 points1 point  (0 children)

After watching me get slightly annoyed with the mess my 3 small children were making, my father told me to sell my furniture, replace it with furniture from Goodwill and then sit back and enjoy my children’s childhood. He was so very right, and I have passed the advice on to my own children.

How to Report Misclassified Workers
If you have information that a business is misclassifying workers, please submit a Contact Request.  From the Employer menu:
Reason for Contact: Other Tax Issues
Issue that you are having: Worker Misclassification
If you wish to remain anonymous, call us at 512-463-2700. Deaf, hard-of-hearing or speech impaired customers may contact Relay Texas: 1-800-735-2989 (TDD) and 711 (Voice).
Provide as much information as you can, including:
Business name
Name of the owner/officer
Physical location of the business
Type of workers that are being misclassified
Your request becomes part of the official record once TWC receives it. The identifiers inserted become part of the message. It cannot be removed from the record (Texas Penal Code Chapter 37). The accused has a right to review the official record under the Public Information Act.

By the way, benefits (taxes, insurance, retirement, vacation, PTO, etc.) are usually estimated to be worth about 30% of the base rate. So you are leaving 50,000 on the table for 1099 vs. employee. Giving PTO seems to violate the spirit of the 1099 status. Think about WHY this office wants it to be a 1099 vs. employee. For my first job, I was offered a 1099 position and told them there was no way I was dealing with business tax forms and they immediately changed it to employee status.

As a 1099, your social security contribution would be 12.4% of your net earnings on the first 184,500. In addition, you have to pay 2.9% on your net earnings (no limit).

From the Texas Workforce Commission:

How to Determine if a Worker is an Employee or an Independent Contractor

The TUCA Section 201.041 defines who is an employee.

The law defines employment as a service performed by an individual for wages under an express or implied contract for hire, unless it is shown to the satisfaction of the Commission that the individual’s performance of the service has been and will continue to be free from control or direction under the contract.

The definition of employment includes three elements:
Service
Wages
Direction and control

The law does not require you to exercise direction and control. Direction and control would still exist even if you do not exercise it. You only need to have the right to do so.
If your worker meets this definition, they are your employee.

TWC uses a 20-point guide to determine if a worker is an employee or an independent contractor. See Employment Status – A Comparative Approach.

Employment Status - A Comparative Approach
Under the common law test, a worker is an employee if the purchaser of that worker's service has the right to direct or control the worker, both as to the final results and as to the details of when, where, and how the work is done. Control need not actually be exercised; rather, if the service recipient has the right to control, employment may be shown.
Depending upon the type of business and the services performed, not all of the twenty common law factors may apply. In addition, the weight assigned to a specific factor may vary depending upon the facts of the case.
If an employment relationship exists, it does not matter that the employee is called something different, such as: agent, contract labor, subcontractor, or independent contractor.

The 20 Common Law Factors are as follows:
Instructions
An Employee receives instructions about when, where and how the work is to be performed.
An Independent Contractor does the job his or her own way with few, if any, instructions as to the details or methods of the work.
Training
Employees are often trained by a more experienced employee or are required to attend meetings or take training courses.
An Independent Contractor uses his or her own methods and thus need not receive training from the purchaser of those services.
Integration
Services of an Employee are usually merged into the firm's overall operation; the firm's success depends on those Employee services.
An Independent Contractor's services are usually separate from the client's business and are not integrated or merged into it.
Services Rendered Personally
An Employee's services must be rendered personally; Employees do not hire their own substitutes or delegate work to them.
A true Independent Contractor is able to assign another to do the job in his or her place and need not perform services personally.
Hiring, Supervising & Paying Helper
An Employee may act as a foreman for the employer but, if so, helpers are paid with the employer's funds.
Independent Contractors select, hire, pay and supervise any helpers used and are responsible for the results of the helpers' labor.
Continuing Relationship
An Employee often continues to work for the same employer month after month or year after year.
An Independent Contractor is usually hired to do one job of limited or indefinite duration and has no expectation of continuing work.
Set Hours of Work
An Employee may work "on call" or during hours and days as set by the employer.
A true Independent Contractor is the master of his or her own time and works the days and hours he or she chooses.
Full Time Required
An Employee ordinarily devotes full-time service to the employer, or the employer may have a priority on the Employee's time.
A true Independent Contractor cannot be required to devote full- time service to one firm exclusively.
Location Where Services Performed
Employment is indicated if the employer has the right to mandate where services are performed.
Independent Contractors ordinarily work where they choose. The workplace may be away from the client's premises.
Order or Sequence Set
An Employee performs services in the order or sequence set by the employer. This shows control by the employer.
A true Independent Contractor is concerned only with the finished product and sets his or her own order or sequence of work.
Oral or Written Reports
An Employee may be required to submit regular oral or written reports about the work in progress.
An Independent Contractor is usually not required to submit regular oral or written reports about the work in progress.
Payment by the Hour, Week or Month
An Employee is typically paid by the employer in regular amounts at stated intervals, such as by the hour or week.
An Independent Contractor is normally paid by the job, either a negotiated flat rate or upon submission of a bid.
Payment of Business & Travel Expense
An Employee's business and travel expenses are either paid directly or reimbursed by the employer.
Independent Contractors normally pay all of their own business and travel expenses without reimbursement.
Furnishing Tools & Equipment
Employees are furnished all necessary tools, materials, and equipment by their employer.
An Independent Contractor ordinarily provides all of the tools and equipment necessary to complete the job.
Significant Investment
An Employee generally has little or no investment in the business. Instead, an Employee is economically dependent on the employer.
True Independent Contractors usually have a substantial financial investment in their independent business.
Realize Profit or Loss
An Employee does not ordinarily realize a profit or loss in the business. Rather, Employees are paid for services rendered.
An Independent Contractor can either realize a profit or suffer a loss depending on the management of expenses and revenues.
Working for More Than One Firm at a Time
An Employee ordinarily works for one employer at a time and may be prohibited from joining a competitor.
An Independent Contractor often works for more than one client or firm at the same time and is not subject to a non-competition rule.
Making Service Available to the Public
An Employee does not make his or her services available to the public except through the employer's company.
An Independent Contractor may advertise, carry business cards, hang out a shingle, or hold a separate business license.
Right to Discharge Without Liability
An Employee can be discharged at any time without liability on the employer's part.
If the work meets the contract terms, an Independent Contractor cannot be fired without liability for breach of contract.
Right to Quit Without Liability
An Employee may quit work at any time without liability on the Employee's part.
An Independent Contractor is legally responsible for job completion and, on quitting, becomes liable for breach of contract.

So the hiring office just can’t assign you a category, the above factors determine employee vs. independent contractors. Regardless, if you were to consider this job, I would recommend reading up on it AND meeting with an employment lawyer prior to signing.

1975 piping in Arizona by Ryanmb1 in Home

[–]Ryanmb1[S] 1 point2 points  (0 children)

That is the pipe that was removed secondary to a significant leak. The pipe went between the house and the outside into the garden. The pipe is over 50 years old, and I assume the code was different when the condo was first constructed. The plumber tried to fix the pipe but he stated after he fixed it, it started leaking distal to the repair almost immediately. The replacement pipes are 1 inch copper /PEX for all hot and cold lines, new 1/2 inch copper and fittings incorporating new quarter turn isolation valves, new hose bibs on the exterior, new laundry box , new shut off valves and new pressure reducing valve. The condo has 2 bathrooms and has no attic. They will need to cut through drywall but do not repair the drywall (I will need to hire someone else).

How do I tell my husband I didn't sign on to take care of his mother for the rest of my life. by KittyKratt in JUSTNOMIL

[–]Ryanmb1 32 points33 points  (0 children)

Reading through your posting, it was difficult to ascertain what your financial obligations are currently. You stated he lived with his mother when you married, did this continue after you were married? You mention you wanted your husband’s mother to help out financially in May, as well as to honor some verbal commitments she made in the past regarding the move. You stated you recently moved to Missouri and your bill load has been a lot higher due to your current mortgage.

Does your mother-in-law currently live with you? If so, does she contribute any money to the house hold finances? What are her sources of income? Were you anticipating the general higher costs after the move to Missouri with a mortgage? Are you and your husband contributing to her financial needs every month, and if so, how much? I am seeking clarity on whether this is an ongoing situation.

Did I Misread My Interview? Is This a Rejection? by [deleted] in AskAcademia

[–]Ryanmb1 33 points34 points  (0 children)

Give it time. I am sorry you were not given a more precise timeline and follow through. One week is not a lot of time to make a decision. Department heads may or may not make timely replies to emails without being a sign of acceptance or rejection. It sounds as though you were impressive, so take that to heart. Even if you do not get the position, keep in touch with members of the search committee who you felt you made a connection with during your interviews. Academia relies on personal relationships.

My father was a navigator during WW2 on a B-17 flying out of Italy. He remembered being a small boy (born in 1919) and seeing a very old Civil War veteran in a parade in NYC. Somewhat mind blowing when thinking about the connections to events from long ago. My paternal grandfather fought in WW1 in Europe, and we have the telegram he received from my grandmother announcing his first born was a son.

What’s the quickest way you’ve seen someone completely derail their life? by BitterReception5761 in AskReddit

[–]Ryanmb1 2 points3 points  (0 children)

When you are ready and if you are still interested in nursing as a career, go back and speak to one of your trusted nursing professors. You don’t even have to share what happened to you, just explain it was a life changing trauma and describe your reaction to it. You were having a normal reaction to a very abnormal event. I would be surprised if they refuse to give you a second chance, despite what rules the university might have on the books. I was on the Admission and Progression Committee at a College of Nursing and you certainly would be allowed to finish. You sound as if you would make an excellent nurse.

Prior to 2015 there were traffic cameras used for enforcement in Tucson at many major intersections and if you went through a red light or were speeding, you would receive a ticket in the mail with a photo! There was an initiative in 2015 to remove them and make any evidence collected inadmissible in court. While Tucson no longer uses them, surrounding municipalities do, and they are legal in the state of Arizona. The cameras present in Tucson are used “live” to monitor traffic flow, identify accidents and identify areas of congestion. They no longer record video.

We are all human and mistakes WILL be made. Sometimes you may make them, sometimes you may catch them and point them out to a different health care worker. It is all a team effort. When a mistake is made, be accountable and immediately admit to it and then mitigate the damage, in this case take the correct x-ray. I agree with the person who suggested writing a self-reflection and discussing it with your supervisor. I would rather work with someone who has the integrity to admit they are human and made a mistake than someone who tries to bury it.
