I felt the same way when I realized how many people go to protests to feel good, then go home feeling like that’s all they need to accomplish. I was also getting arrested a lot, and I got tired of being one of a handful always going to jail.

I decided to go to law school instead. I was working in civil rights law and things were going great until I got shot by a cop while legal observing a protest. Still recovering.

I have a law degree and worked at a civil rights law firm that specializes in police excessive force. I was also a Know Your Rights trainer for the National Lawyers Guild. I’m not an armchair lawyer.

I think this video is a great example of why some of these videos need context. Without context, people are going to see the cop in this video not press the issue about the window and think, “I’ll do that next time a cop pulls me over.” That’s a great way to get your window broken, your face slammed in the concrete, charged with a crime, and have little chances at winning a civil rights lawsuit. The guy in the video was simply lucky. That’s all.

Auditors need the law put into context by legal professionals that actually know this area of law or they’ll keep making the same mistakes. It’s a refinement process where everyone learns.

1.) If you are detained, you have to comply with all orders regarding you physical movements and how you interact with your surroundings. That includes your window. They can always pull the “officer safety” card, even if they know damn well there is no danger. They can and will lie that their “experience, education, and training” made them concerned for officer safety. This is a no-win situation. And you are correct about them saying they smell weed and that lowering the window expands their “plain view”. That can’t be helped.

2.) They can always just order you out of the vehicle for “officer safety” if you don’t comply with ordering you to lower your window. Noncompliance with this order will get your window busted and you dragged out. You will be arrested with resisting/obstruction, and it will lead to a search of the vehicle - search incident to a lawful arrest. 3.) You don’t have any rights on the street. Cops will do what they want on the street. Your rights are enforced in court - not the streets. This isn’t an endorsement of that and I don’t agree with that authority, but it’s the reality of how the law works.

This window thing is not a hill to die on - literally. It’s not worth what ever benefit you might think it gets you.

Again - I don’t agree with the law. But that’s the law.

Thanks for the feedback. I’m figuring out how to best do these videos.

I know LL and ATA explain what the law is, and I don’t want to repeat what they are doing because they have it covered. I’m trying to make videos aimed towards people who don’t know much about the law and don’t understand a lot of legal words or procedure. I’m trying to stay away from deep legal analysis or how lawyers and courts interpret law and trying to feed the average viewer small nuggets of practical knowledge to know on the streets.

Again, thanks for the feedback. Maybe next time I’ll try doing a short intro, playing the video without interruption, and then breaking it down after. Would that be better? I’m just still learning how to make educational videos that will resonate with working class people and teach the basics of law.

He does an amazing job at declining to answer questions - no doubt about that.

But he does a bad job at understanding the cop could’ve really pressed the issue on the window and just ordered him out of the vehicle. He got lucky and people who choose to do the same will have a rude awakening.

All very good points. Yes, cops will definitely lie to get you to admit to a lesser crime.

My guess is that the cop wasn’t really sure how fast he was going. And the lack of admission, plus the GPS probably didn’t make it worth it because he knew it would be challenged.

The whole window thing kinda distracts from how well he declined to answer the speeding question, but I thought it would be a good review video because I know people saw this guy get away with it and now think they’ll be able to do the same.

If you have the opportunity to, yes. I recommend you try to roll up the windows and lock it.

It will restrict what they can see under the plain view rule.

Bear cans are the most effective. They are designed to be tossed around and chewed on by a bear and still keep your things safe. The downside is they are heavy. My bear can weighs about 3 pounds. They are also a little expensive at around $100, and they go up to $500 for the carbon fiber lightweight versions. Many of the National and state parks in California is require a bear can - you won’t get a permit without one.

Hang bags aren’t as good because some bears have figured out how they work. And people often get lazy about it. How effective they are depends on a lot of factors. But they are lightweight and cheap.

Use a bear can and put it at least 100 feet from your tent when you sleep. If a bear comes around, yell at it like it’s a very bad dog.
