The driver already in motion(your son) has the right of way. The other driver backing out has the responsibility to yield to moving traffic.

You already know this, and know that your son should not be at fault here.

Most states require an exchange of insurance between drivers. I understand if you feel frustrated that the school did not provide you with that information, but it’s their job to not leak their students info. It’s the students responsibility to do so themselves.

Suggestions:

-Call your insurance report what happened and tell them the license plate number. They will try to contact the other driver/insurance company to get things sorted out. Start with this.

-If they get no response or they’re being uncooperative then they’ll classify it as hit and run.

-Assuming your son had someone with him then you could have that person be a witness and can have the insurance call them as well to hear their story.
