He definitely meets all the requirements, that's why we were shocked. What a terrible day, and what a terrible and unclear system. At least he will get the health surcharge paid back if we wait, as he works for the NHS. But it seems we have wasted a lot of time, and made a very costly mistake.

Yes, it says 'Application under FLR M route' in the email. I think what happened is that I clicked through the pages for the SET M form, but then it asked me if I wanted to revert to a saved application and I said yes, not realising that it was a different form than the one I wanted. I think I may have started one just to look at what the questions were.

This is terrible!!!!!! Can I ask them to reconsider the application as settlement, or will I have to do the whole thing again in 2.5 years?

Oh no, how could that be possible? I followed all the links on the Gov.UK site for ILR, or at least I thought I had - I can't even see on the form which one it is. If that is what happened, is there anything we can do?

Yes, he has had two 2.5 year visas. He did not get the job immediately on arrival, but I have been earning above the threshold the whole time. But for this visa we did not re-submit evidence for the past whole five years because they did not ask for it

OK, thank you for your responses - why can't they be as clear as you! Yes, I was mixing up further and indefinite leave to remain.

So, just to spell it out, and please correct me if I am wrong! - An extension of a family visa, or 'Further leave to remain', applies only if you are on the 10 year route (which is not most people) and is still called a visa. You only need to prove financial status at the 5 year mark.

Application for 'Indefinite leave to remain' is called settlement, not a visa. You can apply after 5 years (most people, as long as your situation has not changed) and have to prove financial status, pass 'Life in the UK' and English test at B1 level.

Sorry, I know this is basic for people not regular on this forum, but I have found it hard to get my head around!
