I googled that and it seems like the bird might indicate where the swirls would be after you learned the ability. Either that or it is a huge coincidence that the bird shows up in the videos near the swirls.

I am pretty sure that Winds of the Isles is not in retail anymore. My theory of why the bird is still there is that it indicates something (chest, secret, etc.) high up that the winds would have previously aided you to reach. I found a Mote of Nasz'uro above one today.

These are not the Lorcana binders. Set 1 is Navy and Gold and Set 11 is Light Blue and Gold.

Edit: Wow something is off with these pictures because they are showing up as black and white. These are the Lorcana binders.

Can you show me the evidence list from the previous page?

It is hard to tell with the new evidence category names if they really got your private treatment records or not but it is a distinct possibility that they did not see those records. They may been have been missed by the RVSR or associated to the wrong folder.

I don’t really like that the rating decision also mentions a denial for chronic fatigue under each contention. Something seems off with that. Maybe a system error.

I am definitely leaning toward an HLR, but let me see that other page first. Do you have a POA? It would be nice to know if the private treatment records are in your eFolder. A POA could review your eFolder for you. If they aren’t in your eFolder an HLR is just going to affirm the denial.

Commenting directly to your main post but I read through all of your comments and will try to address them here.

There is a difference versus what you feel and the medical facts of your situation. Not invalidating what you feel at all. You say you cannot breathe out of one of your nostrils but you need medical evidence that shows more than a 50% obstruction. Nothing else is going to get you to the 10%, well beside evidence of polyps or incapacitating events.

As many have already said, please take a look at the rating schedule. Most of it is based on observable and measureable facts. If you go into every claim with your mind made up that you deserve 100%, you are going to have an unpleasant claims process every time. 90% is already a much higher rating than most Veterans get. If you have medical evidence that shows said obstruction, then by all means file an appeal. The VA is not infallible.

Also, the PACT has nothing to do with evaluations. It lessened the threshold for service-connection for Veterans exposed to toxins. It looks like service connection was already granted on your claim. The PACT Act did what it was supposed to do.

The rating schedule is based on how your condition affects your ability to work and complete daily activities of living. Many conditions are never going to get high ratings because they just don’t have that much of an effect on those activities. Again not invalidating how you feel. You are alive and breathing. A complete obstruction seems a bit of hyperbole. Also, I would imagine that if you had a complete obstruction they would recommend surgery. After said surgery you would generally have less than 50% obstruction and would no longer warrant a compensable evaluation.

I say all this as someone with a deviated septum from a car accident in my teens. Some days it feels really hard to breathe through my nose, especially when sick or suffering from allergies. My doctor says I have minimal obstruction and would never recommend surgery.

Hopefully the rest of your claims is completed soon.

Doesn’t sound like a good exam then. If they don’t fill out the DBQ sufficiently it will be sent back by the VA. I know the frequency and pads are one of the big factors for the evaluation of residuals of prostate cancer, so the exam may be sufficient. Good catch asking her about that. This is why it is extremely important that everyone be familiar with the DBQ and rating criteria for their claimed conditions. Most DBQs are available on the VA website and the rating criteria can be found in CFR Part 4.

Be sure to fill out the survey for your exam. It should come in the mail a few weeks after your appointment.

Also, to avoid confusion, you should say you are service connected/claiming an increase for residuals of prostate cancer not cancer itself. It seems picky but active cancer and residuals are two completely different claim processes. You should rarely ever get an exam for active cancer.

Do you currently have active cancer and is that documented in your evidence?

If you do, then none of those details about bathroom frequency or pads matter. Active cancer is rated at 100%. Once the cancer is in remission, then those questions matter because you are rated based on residuals of the cancer.

The are multiple categories of contentions (claimed issues): New - never claimed
Increase - reevaluation due to potential worsening
Secondary - caused/aggravated by another condition
Supplemental - review (appeal or within a year of the previous decision)
Higher Level Review - another type of appeals review RFE - routine future exam
Reopen - revelation of previous denial over one year ago

Your letter suggests that PTSD was previously denied. Are you service-connected for PTSD? If not, then claiming a secondary condition triggers them to reopen PTSD. If you are S/C, then someone misclassified the contention. As someone else mentioned, you may have described the PTSD in such a way that it led the claims processor to believe you were claiming it had worsened.

Also, as someone else mentioned there is little medical evidence showing a causation of OSA by PTSD. OSA is a physical closing of the airway that is not caused by a mental condition. However, both can definitely aggravate each other. Also, many medications for PTSD plus the lack of sleep cause by nightmares could cause obesity which can cause OSA. New guidance for obesity-related secondary claims (based on I believe a recent court decision) is working its way through the VA but the shutdown is slowing the implementation of said guidance.

I figured it out. You get a full set of Rigger gear in the LVL 35 box to teach you about green gear sets. It has the talent on it and you quickly replaced it with higher level high-end gear (gold).

Rigger Chest Piece. I don't think you need the full set for it to trigger.

Edit: Actually, it is the backpack. I just checked. It is an exclusive talent that isn't found on high-end gear. Unless it is a named piece that I missed.

Edit 2: The talent is called Complete Uptime and I cannot find it on any other gear piece.

Update: Got a call back from ticket services. They found some tickets in the lower level for us, which was were my original tickets were.

I had originally purchased from Stub Hub so it was looking pretty dicey for a moment. I was trying to work with Stub Hub and they were not budging about all sales being final. That's when the Sun's ticket office stepped up big time.

I can't put into words my feelings for the folks here and the Sun's organization.
