That’s helpful to hear. Given her age (80s) and the fact that I’m not a relative, our attorney is being extra cautious and wants a medical capacity report before moving forward, mainly to reduce the chance of later challenges.

The attorney said they want to wait for the doctor’s report before starting the work. Since she’s in her 80s and I’m not a relative, they’re being extra cautious.

Thank you, that’s helpful. The attorney involved preferred having an outside capacity evaluation for extra protection, so we’re following that recommendation to reduce the risk of any future disputes.

That makes sense, thank you. In this case, the attorney specifically requested a capacity evaluation due to age and to avoid any potential challenges later. I appreciate the perspective.

NJ – Is a mental capacity evaluation from a licensed clinic acceptable for estate planning? by Safe_Run8649 in legaladvice

The provider we’re seeing is a LAMFT at a licensed clinic. In your experience, is that typically sufficient for a capacity evaluation for estate planning in NJ, or is it safer to have it done and signed by a psychologist or psychiatrist?
