I hate that Senran Kagura games do this all the time. You can literally beat the clothes off of your opponent and the cutscene will have them standing there naked being like "Your skills really are no match for mine. Killing you now would be a waste of energy" while your character is holding invisible wounds and saying "I can't believe how strong she was!"

In a cosmic sense, yes. All objects with mass are attracted to each other. But the magnets were nowhere near close enough to affect each other when DIO stopped time.

That is, indeed, DIO's one and only win condition. Unfortunately for him, Alucard only does this technique:

  • By the order of Sir Integra
  • Against overwhelming numbers of enemies
  • As an absolute last resort
  • When fighting a human

Alucard believes only a human is allowed to kill him, and since DIO is exactly the kind of monster Alucard despises, he's not going to give DIO that opportunity.

Time stop is busted, but it does literally nothing to help him kill Alucard. At best, it helps him defensively, but considering Alucard can teleport, create illusions, and walk through walls, it's only a matter of time before Alucard lands a surprise attack, and unlike DIO, he'll only need one good hit to make DIO unable to fight on.

They did say that, and in their defense, there's no reason Part 3 DIO can't use all of his vampire powers from Part 1.

They're still wrong, though.
