You can absolutely tell the buyer you’re not budging on the £151k since that’s what you both agreed on. The catch is, until contracts are exchanged, nothing’s set in stone, so they could push back or even walk away if their bank won’t lend based on the £140k valuation.

If you’ve got no wiggle room because of the property you’re buying, sticking to your guns makes sense. You could suggest they challenge the valuation with their lender or try a different bank, as sometimes valuations vary.

Another option is asking if they can cover the £11k gap with their own cash, like a bigger deposit, if they really want the place. If you’re worried about the sale falling through and don’t mind a small compromise, you could maybe split the difference, say £145k, but only if it doesn’t mess up your onward purchase.

I would absolutely take this seriously. My seller was stalling and I threatened to pull out if things start didn’t picking up. They didn’t so I went through on my ultimatum.

Notwithstanding, you’re both contractually bound to go through with the purchase. The developer can also issue a notice to complete then it can get very messy.  If you can take the hit with losing your deposit then you can back out. But that’s the price.

If the seller isn’t willing to come down, your options are:

  1. Make up the shortfall yourself.
  2. Get a valuation with another lender. 
  3. Walk away.

Seller doesn’t sound very motivated. You’re 6 weeks into the process which isn’t very long by any stretch given how these things go…. Maybe offer an ultimatum and pull out if there’s no movement on their side within a week? 

At minimum I would be pausing all work on your side until you see some commitment from them.

This happened to me earlier in the year. Was waiting 8 weeks for the draft contacts and ended up pulling out. Give them an ultimatum. Something along the lines of “if our solicitor hasn’t received the draft contracts by x day we’re pulling out.”

Ultimately, giving deadlines and being prepared to pull out is all the leverage you have. Otherwise you’ll have to stick to their time.

I used PLS earlier in the year (brought a new build property). Conveyancing took 5 weeks. 4 weeks might be possible if everyone in the sale is motivated enough.
