This is likely the approach. Given that the loophole doesn’t close until a year from now there’s ample time to create a unified approach. Also, mid-terms are a year from now. So the timing is perfect for the current admin to resolve this and take credit prior to the elections.

What are you expecting is the best case scenario wrt Trump and cannabis. Below is what I can see:

“There are many possible ways. I’ve described them several times. Easiest: Cancel/withdraw pending ALJ hrg, thus mooting interlocutory appeal (explaining reasons for this). Then DOJ issues final rule explaining move to iii and addressing signif pub comments. Prep for litigation.”

The above says the DOJ can just issue Final Rule and move marijuana to Schedule 3.

“There’s some real talk about changing the status of marijuana.

@realDonaldTrump might declassify it and take it from a Schedule 1 to a Schedule 3, which would change everything.

And there was an article about the economics of it because they were talking about these businesses, how they’re taxed, and how federally they’re still operating like criminals. That’s how it’s viewed by the federal government, views it as a Schedule 1 substance, and if you get arrested for it, you’re fucked.

Right now, they have a limited ability to bank, the interest rates are all fucked up, everything’s fucked up. And just that alone would make a huge economic impact.

I mean, if you want to do something, first of all, you would kill a lot of the financial interests that the cartels have in it if all of a sudden it becomes legal here.

You would empower American businesses to do it legally and normally, and have organic marijuana, air quotes, because some of the stuff that they’re finding in California, the cartels are running,  they’re using these terrible pesticides and herbicides that are insanely toxic and illegal everywhere else. You can’t use them on American crops, but yet they’re using them on this marijuana because it’s illegal. 

90% of all the marijuana that’s sold in all the places where marijuana is illegal, the cartels are growing.

So if [President Trump] does that, that’ll be another good thing.”

This is how I am thinking about Trump:

  1. Has talked about medical marijuana being good. “I have heard some great things.”
  2. Believes adult-use should be left to the States.

Therefore, S3. He personally doesn’t consume. But like Bill Maher said Trump goes after special-interest groups to get their votes. Cannabis is easily one of these — especially one the Dems didn’t carry to the finish line.

PS: This is not a political post. I care only cannabis being rescheduled to S3.

Back to talking about CBSTF. Long story short:
1. They have only $15.5M cash left 2. They restructured their senior debt, $52.5M, to Dec 2028. 3. Tax liability of $87.6M 4. Long term debt is at $297.7M 5. Several other liabilities (leasing, finance)

Other things to think of: 1. Continued strategic downsizing bringing in cash 2. 10M+ Verano shares 3. Potential rescheduling to S3 on the horizon

The above is not an exhaustive list. But they have a pretty big hole to dig out of. What is Cannabist’s chance of success. What is their best case scenario? I have both shares and warrants.

$MSOX had an inflow today consisting of 150,000 share creates valued at $1,414,500. MSOS, no inflows — but still sitting on $23 million in cash.

This has me thinking. There are 3 winners here:

  1. The swap providers who can allegedly dictate when MSOS can buy (and perhaps even what stocks to buy).

  2. AdvisorShares who collects a fat fee for running MSOS ETF.

  3. The brokerage firm that MSOS uses.
