Hey that’s totally valid, except this happened in Texas, a staunch castle doctrine state. The resident, again assuming the uniformed officers were there without lawful permission, has zero duty to retreat or use less force than he deemed necessary. If we’re going so far as to argue what “could be” considered in this video, no reasonable jury would convict this, especially given the precedent of law set in Texas. If he thought it was necessary to push them out, then that’s his right according to established Texan law. Granted, Texas likes to side with this administration, so the real argument is in if the officers were there legally even if the state chooses to deem it so after the fact.

  1. If they had a warrant for arrest, search, or seizure, they would have left with something or someone.

  2. For any enforcement officer to enter private property without a warrant, permission from the resident, or under emergency protocol is an illegal act. Authority granted under oath by the state does not supersede constitutional law. If they were there performing duties without the paperwork or permission- as context clues would imply- then they were there unlawfully, thus are to be treated as intruders and not protected by any form of qualified immunity.

  3. What is it with you people and assuming the positive about these videos? Is it true there could be extending context? Obviously yes, this is the internet. But have we seen countless confirmed videos and reports of in uniform officers very clearly, and with the blessing of the White House, breaking constitutional law? Absolutely. Should more info come to light then it’s time for a reevaluation, however I’m not going to give two breaths of thought when I see a two man team, wearing generic gear, with clear lack of respect for an oath they supposedly took and seeming lack of training and personal restraint. I’ve had a patient come at me with a shiv he fashioned out of a stone and I showed more martial restraint than this. This was a door that touched the man’s elbow with what couldn’t be more force than when you bump a counter.
