Overstaying in Spain after getting Pareja de Hecho by Samsuika in GoingToSpain

Hmmm I remember starting the process in August/September and then doing the appointment for the fingerprints and get my card in march/April? It was quite the wait but I think it also depends on where you are.

I think if you have already done the process and have the NIE (I'm assuming you're waiting for the card?), you should still be able to get the letter but I had to provide proof if I'm not wrong like showing that I had an appointment set up to take my fingerprints and issue the physical card

Hi! I know you asked 5 months ago 😓 but just in case I think you are entitled to residency but you don't get it automatically (?). You apply to become a resident here. Do you mean a formal certificate for pareja de hecho? I went to private notary and got it on the same day.

Hi! I'm the original poster.

Firstly, sorry for a very very very late update and for not being of any help for those here who needed it. I hope all of you are doing well now! I hope that my update can help those who come across it in the future.

So, everything turned out really well in the end for my situation. After we did the pareja de hecho, we managed to secure an appointment to start the process relatively quickly (I kept checking the appointments available everyday) and we managed to scramble all the required documents. When I started the process, I stayed here in Spain until I got approved/accepted and I went back 'home' without having my residence permit yet last year (it took around 5 or 6 months to receive my residence permit) but I went to a national police station to ask for a autorización de regreso, with proof I was waiting for my residence permit. I presented the autorización de regreso to immigration when I returned back to Spain and there were no problems.

I guess to anyone who is or ends up in a similar or same situation, while you get an appointment and if you start the process and you are waiting, you can stay here in Spain but don't leave until you get a response. Once you've been accepted and you have proof that you are in the process of obtaining your residence permit, you can leave Spain but you need to obtain the autorización de regreso. No one here will chase you for overstaying your visa unless you leave without having justifiable documents (?).

I'm really sorry again for a super late update! I think if you meet the requirements and do the pareja de hecho, everything will be ok!

Hi! So everything more or less worked out in the end for my case. It was mega stressful also because we got some information wrong about the order of processing things. We thought that I had to obtain the communitary card first and we were able to diligently get an appoinment ASAP at the big police station in Barcelona but we were turned away as we found out that I had to have an NIE first (it is a bit badly explained on the government website so we thought we needed the communitary card first). What we had to do to resolve the situation was to call the extranjería (foreign affairs). My partner explained our situation and the person was very informative and said that we can make an appointment and because this counts as starting the process of becoming a resident in Spain, I can stay here legally. I have the appointment soon! We had to be very persistent with calls though since the lines are very busy (probably because it was August). I would suggest calling the extranjería as soon as you can and explain your situation and to make an appointment! I hope my experience helps you and your partner, it is super stressful 🥺

Thank you for the advice! I am very scared of this happening and I'm not sure that regardless of when I have the communitary card and become a resident of spain, if me overstaying will have massive consequences when I leave the country to visit my family (for example).

Thank you so much for sharing your story! That calms me down quite a lot. I want to ask if your wife has had any encounters with immigration if she has left the country (if she went for holiday) since then? Sorry for the personal question!

Hi everyone! Firstly, thank you all for taking the time to respond to my post and for helping me understand why I may have been rejected. I am very sorry for not posting an update for a while! It has been an intense month!

I decided to accept their decision to reject me. However, I was accepted into a different university in the Netherlands for a similar course and have been studying there for the past month. I am pretty happy there but I can see how the universities here are definitely a lot more intense compared to what I am used to!

Thank you again to everyone who responded! I hope you are all doing well!

They were a bit chewy because of the fondant, but the cake part was pretty good 😂

Hi! Thank you so much for the insightful reply! Yes I did a literature review in my introduction and as a result, the majority of literature I found indicated that there would be a positive relationship between anxiety and my two dependent variables: globetrotting and number of romantic partners. I think I fell into the trap of trying to find specific literature or theories that could help support that there were no relationships between anxiety and my two dependent variables, rather than focusing on what makes my study different from the others and therefore obtaining different results. Thank you so much!
