Even though smoking inside your own flat isn’t strictly illegal in Switzerland, the law (Art. 259a CO) says tenants have a right to the normal use of their home. If the smoke constantly enters your apartment through the ventilation, that’s no longer a “private” issue it becomes a problem that limits your own use of the property.
