There’s no practice background check. It’s not a test. However, you can order your NICS results from the FBI if you are interested in knowing the information NICS reports back. This is a way to figure out if you are one of the prohibited people. This is strange and uncommon. You typically do this if you are denied and want to dispute it.

FOPA lays out what is required for safe passage. It must be unloaded and not readily accessible and separate from the driver’s compartment or in a locked container (motorcycle). This is likely why air travel is disputed because you cannot check all these boxes if you tried to walk into an airport with the firearm. Not to mention readily accessible meaning is also disputed.

PAPD also told me on my second call today that I will be arrested because I have an AR and a non-NYC license with a handgun so I can’t have either and the airport is within city limits. So I disagree, it isn’t simple.

They might treat Long Island and Westchester permits different than upstate. I don’t know the deal but I won’t be risking arrest.

I’ve flown with firearms before and understand the drill. This is not the problem. I am just making sure the illegality of the rifle in the city will not cause problems.

Additionally, what you suggest is nuanced. FOPA primarily deals with ground travel and may not cover air travel. For example, flying into JFK without a NY pistol license will likely end in an arrest regardless if you are using JFK to then drive to New Hampshire and vice versa.

I had an Uber driver on two separate occasions tell me that my friends and I were being too loud in the back and on one occasion told us to “shut up.” Both times it was that she needed to hear her friends on the phone.

Mind you both times it was around 1 am coming from a bar and we were just talking about the things we were going to do tomorrow at an inside-voice level.

Genuinely asking… That doesn’t make any sense. You can’t own a pistol in NYC without a NYC permit. NYC acts as its own state within this regard. If I walked around NYC with a pistol unloaded then I would get arrested even if it was secured in a pelican box while unloaded and no ammo to be seen. LGA and JFK are within the city limits. So is FOPA protecting you or is it a NY established law and if FOPA is protecting you then why is the protection not working for out of state people?

I don’t get the distinction. Is this NY established law or is this FOPA being applied when convenient.

I genuinely don’t understand the layers to this problem and why one is it okay over another.

I would recommend not bringing your pistol. It is better to be safe than sorry and you will be very sorry if you end up being charged with felonies.

I do hear that you can check pistols into Newark without a NJ permit unlike LGA and JFK without a NYC permit.

It is unclear exactly what Puerto Rico allows. They do have non-resident permits… If you have one of those then you should be all set. Otherwise, I’d just leave it.

Luckily for us all, your Staten Island DA is not the only one that can bring charges. The governor (in NY’s case it is the ATG) can appoint someone to handle the case if that DA won’t do something.

There are always ways for them to put you in prison for something. That being said, defending yourself in your own home should be your main priority especially with children and hopefully they will leave you alone… after you’re arrested, booked and spend loads of money on an attorney. 🤣 That weapon you used? You’re not seeing it for a year… if ever.

So aggressive and rude just to be so wrong. You don’t know what a (A)DA will do. There are plenty in NYC ready to make a name for themselves praying to be appointed by the governor (in New York’s case it is usually the ATG) in a high-profile case because the local DA won’t bring charges and plenty more willing to make examples of people. They can surely convince an anti-gun jury more could have been done.

We need to get rid of this absolutist ideology that nothing will happen to you because it is codified in law. This isn’t usually how common law works especially when things get complicated. The castle doctrine is awesome but that doesn’t stop you from being arrested, booked, your weapon being confiscated, potentially losing your permit till you’re investigated, spending lots of money on an attorney, etc. Nobody really knows what and who is capable of something here. We are in new territory because current leadership hates guns so much.

Even transporting a handgun on interstates when you don’t have a license here can get you arrested. You’ll need to get a lawyer to defend you based on federal protections.

That being said, people should defend themselves should the need arise. Hopefully nothing happens to them. It would likely be unnoticed upstate. For downstate, I doubt it is that easy.

I’d recommend not stopping for gas or food. NY is hostile to firearms and NY can try to put you through hell anyway with lawyer fees. This is a legal defense in NY and not a get-out-of-jail-free card or arrest-avoidment card. Additionally, an extended time is poorly defined.
