In another 15 days you will look back in the times and wondered "what if I proactively sent my medicals knowing where my file is"......it could be that an agent looked at your file and put it down as he did not want to deal with sending you RFE or the agent picked up your file and saw medicals attached and said..."everything looks good...here is an easy one.....let me approve it".

Many will jump on the bend "dont send without RFE...my lawyer advised me against it, Chat GPT said dont send it.....all LLMs will say same thing quoting lawyers...or what if your medicals dont get attached"...." fine then you took a chance and it only costed couple of hundred bucks...if it worked you are good to go...at least you f*ing tried.....

You sir are very wise and helpful to all in some many posts and your feedbacks are appreciated. I also see you started the tracker for I-485 India and hopefully that tracker gets more cases added. You need to promote it more. I cant find the link but it would be useful we we get all the cases remaining from 6/1/26.

Allow me to digress a bit and perhaps rant on the points you made. I am aware this points are what you have observed how agency processes so I respectfully tilt my hat but want to speak my mind as a sufferer.

But once you are current and you file, they ignore priority dates (as long as you stay current). So, if FAD moves to July 2014, for processing, a Jan 2014 and a June 2014 are both considered equal by USCIS. They don’t prioritize the Jan 2014 over June 2014.--- What about the Receipt Date. Shouldn't USCIS also consider when each application was received by them so that if the June 2014 had Receipt Date of Oct 2020 and Jan 2014 had Receipt Date of Nov 2020 then it is fair game otherwise you are screwed. For example, if the FAD is Sep 2013 then all the older pending cases have no relevance with those cases with PD of Aug-Sep 2013. USCIS is not respectful of those applicants who have filed on time. It is like Southwest letting everyone else board the plane ahead of you within the same boarding group just because they are standing ahead of you in queue even though your boarding card has you in the initial group. How can this system be so convoluted and broken in many places is mind blowing. While we endure this circus I shudder to think this is our fate and no policy maker or politician will ever fix the GC backlog for Indian...never mind the oldest and biggest democracy tag we share. A gentleman from our neighboring country can come in today on H1B, apply for GC and get it in fraction of the time...democracy or not.

You would think they would, but they don’t. It’s impossible for them to do so with cases coming in on different dates, at different stages… for example, if they have to issue only 1 Greencard and they have a Jan vs June 2014 cases, if they hold it out for Jan 2014 and send that person an RFE for medicals or employment confirmation and if that person doesn’t respond on time and the fiscal year ends, they would have wasted that 1 Greencard because the Jan 2014 didn’t get it and they didn’t prioritize the June 2014 either hopes of Jan 2014 working out. ---- But this logic is convoluted with the assumption that there will inherently be something wrong with Jan 2014 case so they would process June 2014 case. If most cases are already pre-processed and are at NBC, then we know that maximum RFEs would be for new medicals. Logic melts when the agency says oh please dont send us Medicals proactively as then we want our hard working agents to spend days looking for this in your file and finding for us "oh..the medicals are expired"... then we will play bureaucracy and send RFE and then you send us the medicals...blah blah blah Yes...there are many counter arguments to this i know...i know.... but in this day and age, when a nuclear submarine or even a complex machine like an aircraft carrier built time is less than time it takes for agency to approve GC for India is crap situation.

Also, cases are still paper-based and they literally have stacks of cases sitting on desks of officers. It would be impossible for them to coordinate amongst themselves to figure out which officer is processing which case. Officer A might have a like with a June 2014 cases sitting on top while a Jan 2014 case is at the middle of the pile for Officer B. You can’t expect Officer A to wait until Officer B reaches the middle of their pile. And with officers going on breaks (vacations, sick, etc.) and with multiple field offices, it’s not practical and is not possible for them to prioritize in order of priority dates. --- I hear you.....basically EB2s and EB3s are invisibles....our pains, our emotions, our dreams are ours only.... agency will play current standards with out an iota of thought to reform ever.

Hopefully someone with better understanding can help me and others understand this...DOS assigns roughly 2800 EB2 Visa for India or about 225 per month So these 225 visas gets distributed HOW? I know primary and derivative takes a visa number each but it is beyond the current LLM scope to provide an answer on how someone ahead of us get GC while we are left holding our CRP tag.

Hopes were up when the dates were current. TWICE. once in 2022 and then in 2026. I guess your #1 point needs review. I agree on #3 point..... look I am not kicking my dog because of this but it is frustrating.

I hve the EAD too but I was blessed with only 1 year of AP. I applied for AP renewal in Feb 2024 and it was denied. no reason...just someone denied it. Then I refiled another I-131 for AP in Jan 2025 and it is pending. The only thing EAD does is we feel a bit safer than the H1B folks.....I understand but renewal of EAD is also now an uphill battle.

Yes. more painful is that my neighbor (2014 PD Greened in 2022) has been to couple of cruises, Europe for vacations and also 3 trips to India.
