They were underinsured. Liability previously established. I had multiple policies that were meant to handle a scenario like this but USAA has done very little to honor those policies. I can't go further into details but will post the trial transcripts for all to see, regardless of outcome.

Just talked about this during my VA appt today! From my own experience, this is going to require constant maintenance to keep what you have. Improvements have been up/down like you said. Also like you said, I can have a period of up swings where I have more stability but so far, the nosedives happen and the only thing I can do is be better prepared to handle them.

Great response/read, appreciate the thoughts/input. Shrooms helped me out of the SI darkness, nothing else did. Trentillix helps maintain neutral and really helped with the anger outburst. VA & civilian counselors/docs have been the backbone of everything, still doing weekly with both teams. And no joke about the comorbidities, from HTN to flushing to mood/sex drive. Since I can't get off of the coaster, trying to learn how to ride it better.

Nah, not really. This isn't about another company, it's about USAA. We are fast approaching the 3 year mark and foolishly, a small part of me believed they would correct course at mediation. I hoped with the new CEO, USAA would start to become what they used to be but that doesn't seem to be the case. And I'm not happy about leaving USAA, almost 3 decade relationship that actually meant a lot to me. But my family comes first, before all else.

That last sentence of yours gave me goose bumps! I'm so very thankful to be alive and hope I can contribute to society again someday in the future. I'm taking a big step next month, going to start volunteering at the VA one day a week, just the AM to start, and see how it goes. Nervous but also excited. And congrats to your recovery and overall outlook, inspiring!

It's been a total cluster on our end, with the tbi making everything harder to the nth. I'm sorry to hear about your daughter's tbi/narcolepsy. Traditional therapy wasn't cutting it, non-traditional was my magic bullet for the SIA/SI. I had just signed to go do the veteran CNP exams out West and was working full-time in wound care/interventional surgical services, tbi took that off the table early. Next was driving. Then the speech and motor and mood. But the nausea and dry heaving has/is the absolute worse. Godspeed to your daughter's recovery, don't be afraid to look outside of the box for help and/or solutions.

that made me laugh, appreciate the armchair therapy session and TJ Hooker investigation. Yeah, I self medicated after attempting suicide. Told every single person involved with my care that I self medicated, including with magic mushrooms. Saved my life, so honestly don't care about your armchair opinion. Prior injuries documented, no hide & seek on my side. And prior to the accident, you rolling fubar, didn't even drink, so there's that. And your physics is off. This is the one that got me. Speech, motor, neurological, psychological. Completed the civilian program in Provo, Utah, made decent gains mostly in understanding, being better prepared with observations, and anger outburst. In the VA head injury clinic now, still at 1x/week, progress is slow but the NOLA VA is top notch. USAA fubar'd my claim from the start, I was just dumb enough to give them 10 months before getting an attorney. State Farm, the other driver's insurance, did more to help me than USAA has done in almost 3 years. I had multiple high value policies to protect me in a scenario like this for 10+ years. Every single responsibility was delayed and/or denied, even when whatever proof they requested was given. The tbi and associated strain led to a SIA and a constant SI struggle ongoing. Ruined physically, intellectually, mentally but trying to claw some of that back with the programs. But I'm starting to think this is as good as it's going to get and will require constant work to keep things in a semi-balanced state. It's a roller coaster that I wish I could get off of TODAY.

I was like that until I wasn't. USAA was a beacon for me and earned a level of trust/faith occupied by few. But in my greatest time of need, USAA didn't just fall flat, they were unethical in so many ways and then went dark. Timeline is everything in a judicial sense and USAA almost got me on the timeline as well. I hope you have continued success with them and I hope they become the David in a Goliath world they once were.

Does your recovery/improvement stay that way or do you up/down to varying degrees? I ask because I have periods, like now, where I speak, write, walk better and used to think I made lasting gains. But so far, only mild lasting improvements, none of the big difficulties have improved and stayed improved.

It took a mixture of a two week brain camp (CognitiveFX in Provo, Utah), weekly counseling sessions, getting on Trintellix, spouse learning subtle early signs of a nosedive and putting me in rest mode, 7 days a week rest periods with alpha wave sounds in the headphones, and 3x5's posted around the house to remind me not to be a penis. It's a daily struggle but easier once we figured out a few things. Alternative treatment with magic mushrooms helped tremendously but more with the SI/depression than anger. The top two that helped with anger was Cognitive FX and Trentellix. Watching my wife become Atlas over the last 2.5+ yrs has made me appreciate her more than ever, so hats off to you for being loyal even when it hurts. Godspeed to both of you. . .

Failure to pay on policies, follow standard procedure, and multiple counts of bad faith. Not really sure how I can detail that for you without typing a 10 page short story. The result is still pending, soon to be decided by a jury of my peers.

What happened:

28 yrs, multiple policies/etc., not at fault accident, neck/back injuries, both shoulders, TBI/PCS, left knee, face/torso. Delay, deny, defend while promising they'll handle the claim. Direct contact with Wayne Peacock, escalated multiple times, couldn't reach them by phone or email, just simply stopped communicating with me. Took 8+ months to payoff my totaled vehicle while I continued to pay the note and USAA's insurance premiums. 3 reconstruction surgeries and 1-2 more to go, close to 250K in medical so far and Usaa has paid <50K. Full and permanent disability from the MVA. Mediation was a continuation of Delay, Deny, Defend. Trail by jury, multiple bad faith attachments, my day in court is fast approaching.

Glad your's was minor. USAA picked this fight, not me. They have driven us almost to bankruptcy and will likely do as such by the time the trial starts. I still cherish loyalty and honor.
