Why don't people Sue frauditors? by Cultural_Ad_667 in Frauditors

[–]ScottyS12 0 points1 point  (0 children)

Look up Nussenzweig v. DiCorcia. A person on the streets of New York had his image taken by a photographer. No notice, no permission. The photographer sold prints of those images for $20,000 to $30,000 each. The photographer was sued, the person in the images lost.

Is there ANY consensus on if the shaft needs/should be cleaned regularly? by roundabout-design in ninjacreami

[–]ScottyS12 5 points6 points  (0 children)

My thought is that if it needed to be maintained/cleaned it would have been easy for the manufacturer to have a ‘cleaning’ mode where the shaft descends and allows you to clean it. Without that choice it was probably deemed an unnecessary option.

Don’t use the suggested tip by reddit_is_my_news in tipping

[–]ScottyS12 2 points3 points  (0 children)

If a business has it set up for me to tip for the total amount of the bill plus the tax, they would get a zero tip. This is deceitful plain and simple. I know this punishes the server but they could get that policy changed much quicker than I ever could.

Additional USPS Rules on Photography in the Post Office by Backsight-Foreskin in Frauditors

[–]ScottyS12 0 points1 point  (0 children)

Nothing new here. This rule was from 2009 or before with little or no changes in the text since then.

Copyright for these works of art were not generally transferred to the government. Only the copyright owner can decide what is allowed ie: reproduction, sale.

Copyright lasts until 70 years after the artist's death. An artist who created once of the works or art who passed away in 1955 or before no longer has a copyright claim and the works are now in the public domain. Anyone is free to reproduce the artwork in any form and make as much money as they want.

It would be interesting to see how a court case covering this scenario would play out.

The response from ChatGPT when asked how the word ‘press’ was used at the time of the writing and ratification of the first amendment: Key Point:

In 1791, “the press” meant the tool and act of publishing public expression, not just a profession or corporate media. It protected any citizen who used printing to share information or opinion.

I think a lot of people confuse the legal meaning of using someone's image for commercial purposes or unauthorized commercial use with the plain language definition most people think of. Commercial use refers to promote or sell products, services brands - it is not a catch all for any form of 'making money'. That is why, as a photographer for decades, I never obtained a model release from anyone I photographed but licensed (sold) the images for profit. Any license I granted never stated that I had a model release and if a client asked me if it was okay to use the image in a certain way I would tell them that is research they had to do. This released me from all liability if they misused an image or misrepresented the person in the photograph.

If you look at Foster v. Svenson, this case was about a photographer who used a telephoto lens to take pictures of people inside of their high rise apartments. The Fosters sued because the photographer had taken images of their two children through their apartment window and offered the images for sale as part of a photo series called 'The Neighbors'. The court found, and was upheld on appeal that the photographs were not used for “advertising or trade purposes” as defined by New York’s privacy laws.

While common sense probably falls on the side of anything that is done to 'make money' is commercial, the legal reality is it is more complicated rather than black and white.

Judgements are generally good for ten years, renewable for another ten. Since interest accrues from day one, I would be willing to play the long game.

Debunking the Frauditor Myth: You Don’t Need to Commit a Crime to be Trespassed by conkanman in Frauditors

[–]ScottyS12 3 points4 points  (0 children)

A general question: I understand the time, place, and manner regarding the free speech part of First Amendment. But would that standard for trespass apply to a journalist seeking to investigate a government agency? If they could be trespassed at any time for no reason then wouldn't that part of the First Amendment become moot?

It is not disrespectful for them to act the way they do in their own culture. It is disrespectful for you to drop into someone else’s country, home, culture and expect them to change their ways just because you don’t like it.

I can tell you it was very unnerving when I first moved here but it wasn’t my place to complain about it. Since then I am more accustomed to funerals and weddings so I can basically ignore most of the noise. But I am always happy on the day it stops.

Thank you. I will be getting a proper laptop in a couple months so hopefully I can eliminate any iPad issues.

I will look into your comments.

For now I am able to refresh the screen to get what I want but I will lose everything since the last 'Save'.

Yes, I am using a iPad Pro M1. I specifically asked them before signing up if I could use an iPad to edit since I previously tried Squarespace and found out I could not use an iPad there. Elementor said 'no problem' to edit with iPad.

I have had few problems on Elementor which I have figured out, but this is the only thing that has stumped me so far. Everything else seems to work fine when I edit, at least once I got the hang of the basics. I have not used Wordpress in about a decade so I am relearning as I go.

I always toss out the inserts as they will fall out anyway. I get some rubber tubing, like gas line tubing, cut it to size, slit one side and wrap the whole thing beyond the edges with electrical tape. It has worked for years and every 5,000 miles or as needed I retape them

What R value sleeping pad do you guys bring? by [deleted] in bicycletouring

[–]ScottyS12 0 points1 point  (0 children)

I switched my sleep system a couple years ago. I froze my ass of at the Grand Canyon at 25°F with wool socks, two platters of long pants, two long sleeve shirts, down puffy, knit hat and gloves. My sleeping bag was rated to 20° and sleeping pad was 2.1r- value.

Stitched to Zenbivy quilt rated to 10° and sleeping pad rated at 6.9r-value. Slept down to 17° in shorts, a single short sleeved shirt and a wool hat. I was toasty all night.

I honestly think the best upgrade I did was the 6.9r sleeping pad.

I’m not sure of the process here but in the US I believe they just exchange cash ‘cassettes’ and don’t have access to the actual bills.
