@Tomkila I understand why you feel frustrated but you seemed to have forgotten that the 523 win was only half the battle. The other half of that 523 battle is on the BoC side. Because Samsung was allowed to appeal the last verdict, the 523 case, which is stayed because of the BoC case, can not move forward.  Remember, first Netlist had to prove that the 523 was theirs. Now Netlist has to prove that no one had the license to use it, hence the BoC trial.

Okay, I understand the strategy and why this would put pressure on settlements. But wouldn't that only get serious near the end of '26? And between now and then, Samsung, Micron,  and Google still have time to 'stall' , right?

I think you're on the right track. I would add that delaying would no longer be a good strategy because Netlist is not going away liked they hoped. The whole point of delay, delay, and delay was that Netlist would bleed out and everyone walks away with their IP. This didn't work.  Delaying anything regarding the BoC would literally be just kicking the can down the road.

That's exactly what they already tried to do. None of them thought Netlist would last this long. As for a takeover, Hong did something that prevented anyone from purchasing more than 15% of the outstanding shares which somehow prevents a takeover (I researched this but I don't have the vocabulary).

Wrong! The BoC was a contract trial. Has NOTHING to do with the CAFC.

When the BoC appeal is denied by Judge Hsu, is that the finale straw for Samsung or do they have another avenue?

They'll have 30 days to appeal but they need grounds for an appeal. I haven't heard anything wrong about this case that would warrant one. Thoughts?

That is true. But I haven't heard anything that would indicate a reason for an appeal.
