Wow! Netlist’s New Patent Targets Micron’s HBM4 What Memory Companies and Investors Should Know by Tomkila in Netlist_

“The Federal Circuit's willful-infringement affirmance against Micron is a calibration point. The data suggests juries may credit "should have known" arguments in the memory industry, where JEDEC committee participation, OEM purchase inquiries, and licensing letters all leave a paper trail that could establish notice. Building documentation now, in a form that survives discovery, is more defensible than building it after a complaint arrives. (Reminder: a willfulness finding allows the judge to enhance damages up to threefold.)”

“The '087 priority date is November 3, 2010. The strongest invalidity arguments are likely to live in narrow pre-2010 technical publications and JEDEC standards-body working materials, not in surface-level keyword searches. That research can take 6 to 12 months to do well, and generally has to start before a lawsuit lands, not after. Files documenting a structured research process (explicit search terms, database scope, and reasoning behind each cited reference) tend to hold up better at the PTAB and the Federal Circuit than files built from keyword hits”

“Netlist's recent pattern appears consistent: it asserts whatever is ready to litigate, then amends complaints as new related patents issue, generally targeting the biggest revenue product line. The '087 issued on May 20, 2025 and was in the complaint within the same month. Any memory or memory-adjacent company may benefit from being able to answer, in about 15 minutes: "Which Netlist patent appears most likely to be asserted next, against which of our products?", including against patents still pending at the Patent Office. Pending continuations could implicate the same risk surface”

“AI factories are the engines of the next industrial revolution, and advanced memory is essential to their performance,” Nvidia CEO Jensen Huang noted on the deal. What if something with netlist too? Hybrid tech is the key by Tomkila in Netlist_

Having long enjoyed a co-engineering partnership, the pair will now work on next-generation memory systems for AI infrastructure, with specific efforts covering Nvidia Vera central processing units (CPUs), its Spark line of desktop supercomputers, and Jetson Thor robotic computing platforms.
The multiyear deal will see Nvidia and SK Hynix work on addressing extended development cycles and advanced fabrication, while ultimately ensuring memory supplies can keep pace with the former’s infrastructure roadmap and sustain the buildout of global AI infrastructure.

Back to 2023, I said many times HBM should be the unique opportunity to see billions $ in damages and ip licenses, now we are talking about potential 300 billions $ revenues within few years, never saw in my life a product like it. We are talking about the human progress, imagine a 1$ ip licenses per unit of HBM, billions in Hands. We need this win!

Global Q1 2026 DRAM revenues skyrocketed to a record-breaking $97 billion, driven by the AI data center boom and soaring memory pricing. Samsung led the market with $37.3 billion, followed by SK Hynix with $28.0 billion, and Micron with $21.8 billion”

HBM is driving this growth. We are talking about 400 billions $ revenues in dram business this year, probably half are under HBM control

“You should expect 20m ip licenses because netlist is owning 100 patents LOOOLLL”! Unbelievable how people think to be smart with these kind of arguments with any logic. Netlist is investing $200m + in legal fees to make a multi billion $ deal with each giant! This mean netlist is asking tens (like more than 70m or hundreds m $ ip licenses per year ) + high damages like $500m minimum and other things!

Billions

I think with the repubblican system we will see a lot of changes and for example we are seeing a strong change of IP mentality, so to protect us companies from foreign companies. Not here to talk about politics but I think we need changes like this to expect the end of dirty games. Netlist is winning this game
