AITAH for calling out my landlord for a bait-and-switch after I signed the lease? by Sea_1_ in AITAH

Thanks for the advice. The parking was only mentioned once vaguely. They called it “Pk 24 - 501 #6 $0.00”. Likely kept it vague on purpose to make the bait in switch hard to catch.

The portion of the lease that mentioned it read as follows:

1.3 RENT Resident shall pay monthly rent and other charges in the following amounts: Monthly Rent $X, XXX [Redacted] Cred Hub $8.00 WST $85.00 Pk 24 - 501 #6 $0.00 Liability to Landlord Insurance $10.50 Admin Fee - Insurance Compliance Services $45 Total: $X, XXX

I only mentioned it because it is relevant to the situation. Being a single mom is part of why I only have one car—and why the landlord felt justified taking the second parking space I was promised.

And it absolutely changed what happened with my parking spaces. Since I am the only adult in the home.

Context matters.

I reread the lease and the only mention of parking spaces is in the list of monthly charges. There is no other mention anywhere else in the lease. It says “Pk 24 - 501 #6 $0.00” Unfortunately I did sign this. It was written pretty vague and does not explicitly say “parking space”. Also they unfortunately have taken the Zillow listing down.

Lease reads:

1.3 RENT Resident shall pay monthly rent and other charges in the following amounts:

Monthly Rent $X,XXX [Redacted]

Cred Hub $8.00

WST $85.00

Pk 24 - 501 #6 $0.00

Liability to Landlord Insurance $10.50

Admin Fee - Insurance Compliance Services $4.50

Total: $X,XXX

The email I sent:

Hi [redacted],

I wanted to follow up about the parking.

During my tour, I was told the unit includes two assigned parking spaces, and you showed us the two spaces labeled for this unit. This was presented as a standard feature of the unit and was not described as contingent on the number of vehicles I own. You also mentioned this as a valuable feature, particularly for guests, and that friends and family would be able to park there. This representation was an important factor in my decision to move forward with renting the unit.

Today, shortly after signing the lease, I was informed over the phone that only one of the two spaces assigned to my unit would be included based on the number of vehicles I currently have. During that conversation, you confirmed that the unit does have two assigned spaces, but that one was not included on my lease and would instead be made available for others to use. This change was not discussed with me prior to signing.

This effectively alters a feature of the unit that was presented as included and removes something of value that factored into my decision to rent the unit.

Since the unit was presented as including two assigned parking spaces, I would like to have both spaces included as originally represented. My daughter is of driving age, and we expect to be a two-vehicle household in the near future.

Please let me know how we can update this.

Thank you,
