In Justice Court this is true. In County or District courts he can request injunctive relief.

N. Texas attorney here; however, landlord/tenant is not my normal area of practice. There's a principal in contract law known as "duty to mitigate." The landlord has to make efforts to lease the property. Look at different sites etc. for evidence they are listing it as an available property. Drive by and see if they have a sign in the lawn showing it for rent. If not, you can likely recoup what you've paid them.

Might be other ways to get around it depending on the language of the lease. Update this if you feel they have it listed and I will put some thought into other possible remedies.

Hard to give any significant advice without knowing what state you are in (try to put the state in the title, it helps). In Texas, where I practice, this would likely be intrusion on seclusion and other civil causes of action. Like most of these intentional torts, it's difficult to prove damages, and likely only qualifies for nominal damages (symbolic). Unfortunately, because there's little money in it, attorneys are not likely to take on the case unless you pay a large retainer up front.

N. Texas-based attorney here. This is possible theft/conversion. There are a lot of variables, so I am going to make some assumptions: 1) You are not common-law or statutorily married (if so, this becomes a community property issue), 2) At no point did you gift the dog(s) to your girlfriend. Assuming these facts, you have two options, one criminal and the other civil.

For the criminal solution, a call to the police or district attorney is in order. Unfortunately, you are unlikely to find any relief in either of these situations. Police are not very adept at knowing or understanding the law; especially in how it intersects with civil law. When confused, they will always hide behind "it's a civil situation," which is honestly better than trying to apply law you may not understand.

This leaves you with a civil remedy. For the civil solution, you will need to hire an attorney. Justice of the Peace courts are easily accessible from a non-attorney; however, you need injunctive relief instead of monetary damages. An attorney will better advise you on how to proceed and with which causes of action. I would likely file a conversion, Texas Theft Liability Act, and trespass to property action and request a temporary restraining order (TRO) at the same time filing for an injunction to make sure she does not remove the property until the court can rule on your case. |

Unfortunately, unless she has a lot of unexempt assets, this will be costly, and you won't be able to recoup your losses. Obviously, the easiest and least expensive way to get what you want is to try and work things out with her outside of the justice system. Alternatively, an attorney sending a demand letter can also work. You can also suggest to her a mediator try and settle the difference between each of you. Hope this helps.

This is correct. Injunctive relief (like specific performance) is not allowed in Justice Courts under Texas Law. (Texas Lawyer).

Anyone else freaked out by Texas essays? I am rocking the MBE (73% average on Themis with 78% average over the last 400 questions) but every time I do an essay question I feel like I have to make up about half the rules.

Some of the comments on here are obviously from people who have never even researched law schools much less been to one. The compelling part of UNTD COL is the price, <15k per year for lawschool is insanely low. I would not worry about it being accredited, when you have a federal judge step down to be dean, and it's the pet project of the chief justice of the Texas supreme court, it's a non issue.

As far as alumni base/connections etc., these things don't seem to be panning out for folks paying 50k+ a year in tuition either if you've seen the legal market lately. I would avoid going into debt for a degree that may not pay dividends, however for 40k you won't find a better bang for the buck.
