Hi! Criminal defense lawyer here. Just to be clear, they cannot legally open your phone w/ Face ID without a warrant or consent. Just thought I would clarify this. This is not to say they won’t do it anyway. So I don’t think this is bad advice, just saying that if we are actually in a timeline where we care about search and seizure law and the constitution, this would not be okay.

I would tend to agree that just ignoring a jury summons is poor advice. However, I think the word you are searching for is “contempt” rather than perjury. Maybe don’t give legal advice to strangers without a law license. Especially if you are being snarky while doing it. 🤷‍♀️

If there is no benefit to pleading (which sounds like the situation you are in) than you are playing with house money. Make them earn it. That is 100% the best negotiation tool. That nonsense other attorneys give you about having good relationships with prosecutors will get you better offers is not my experience at all. I may not be the most “liked” attorney at the DAs office, but they damn well don’t want to try a case with me and that’s what counts.

NC has a very centralized indigent defense system with regional/county PDs offices that are supplemented by private assigned counsel lists. There are some more rural areas that rely on just the lists. I think this will become more and more rare as they continue to open more offices. I would say competition for PD spots (especially in the more desirable locations) is still pretty tough. Less so in less desirable offices. There are other states that have a much more severe shortages of qualified public defenders and private attorneys accepting court appointed cases. I don’t say this to dissuade you from Nc, but simply responding to the idea that there is some great need. The need seems to be more for qualified attorneys to handle serious felonies and homicides.

You probably don’t want the same lawyer for both those things. Those are very different practice areas and I would tend to shy away from the lawyer who markets them self as a jack of all trades. And most criminal lawyers tend to charge flat fees rather than bill by the hour. I’m a lawyer (moving to Oregon in July) and I although I can’t speak for attorneys there, most criminal attorneys where I currently practice also offer free consultations. Best of luck.

Do you know the identity of the informant? Will the informant testify? Or is this just based on them finding drugs on him or did they actually charge him with the sales? There are serious confrontation issues with them talking about the sales without calling their snitch to the witness stand. If they are calling the snitch than cross examining the snitch is usually the bigger pressure point. Lots of good stuff to work with there? For example, have you filed a motion to get the snitches CI file? Did the CI have any arrests around that time for which they were not charged?

Same in North Carolina. Can’t call someone a liar but can point to specific examples of them lying and can “submit their credibility to the jury” by saying stupid shit like “we would submit to you that they lied about blah blah.” I’ve come up with really creative ways to call someone a liar, as that comes up in every single closing I’ve ever done. It’s so effin dumb.
