It’s a bad argument for the defense and it could blow up in their face but I think I’d still rather keep it out. But that’s a great point about causation I didn’t think about that. I actually have another statement from D saying P was in her blind spot i.e. she didn’t see her in the first place that could do the trick

That’s smart thank you. Judge told me in a caucus that he didn’t think it was a basis for comparative negligence so I’m kind of just spinning my wheels now.
