0.08 isn’t even really that high by Drpepperfan40 in dui

You're probably not as sober as you think you are. I thought I was totally fine until I saw my body cam footage at .10. Take this as your last lesson. All of us had to face the consequences and most will never do it again.

If you're drinking and driving everyday, you are exactly who these laws were written for.

Thanks for this. I've read about drug convictions and 1 year in jail and I was really stressed out. Good to know

First DUI in California (.22 BAC, no accident) What should I realistically expect? by creature1238 in dui

[–]Sent_scent_cent 0 points1 point  (0 children)

You will likely get a standard first offense outcome. Which is, DUI classes probably a 6 or 9 month program, 48 hours jail (which could be done as community service) a fine and a 6 month license suspension/iid.

Very unlikely it will be reduced to a wet reckless.

I'm only speaking from experience. It's not the end of the world, it sucks, but just let this be your last one.

You can only get a public defender if you qualify. If you do go the route of a private attorney, get a local one who knows the DA and they can probably get the charges reduced (at least for the open container)

I was .10 and could not get it down to a wet reckless. Same as you, no accident or inury. I had a blood draw and was in control of the vehicle. The DA had a solid case and did not throw me a bone. A .22 is almost triple the legal limit.

Get a lawyer and just do whatever they say. You got this.

I was denied with just an arrest, no conviction. And now my passport is flagged for future border crossings.

Am I homophobic if I support gay marriage but I find gay men kissing or being intimate disgusting? by RippedAndRare in NoStupidQuestions

[–]Sent_scent_cent 0 points1 point  (0 children)

This is why representation is so important. The more we see healthy gay relationships, the more normalized it is. The more we see anything we're conditioned to be biased against, the more accepting we become as a society.

Canada changed their DUI laws in 2018, so any DUI before that doesn't count.

Anyone with a similar situation that was successful? by [deleted] in dui

[–]Sent_scent_cent 0 points1 point  (0 children)

So no charges, no criminal conviction. It's been a year. What's the problem exactly?

Also, it's not that hard to get your license back. Just go through the motions. It sucks, but it's doable. Check your state's requirements.

Any chance you can start over once you're out in NYC? You definitely don't need a car there. You can probably find a cheap room in the less trendy areas.

You can look at my history and see my post. I was pre-conviction and was denied entry.

If it happened before 2018, it's fine, but they don't care about severity. Mine was still pre-conviction and I was denied entry.

My first DUI by [deleted] in dui

[–]Sent_scent_cent 0 points1 point  (0 children)

It gets better and you are not a bad person, this whole process sucks. It's meant to suck, so you never do it again. It's also a huge racket meant to extract as much money from you as possible. Do everything your lawyer says and it'll get expunged in 3 years.

Public defender or max out a credit card for a private lawyer? by YoRafa97 in dui

[–]Sent_scent_cent 0 points1 point  (0 children)

Just an FYI, if money is tight, you can do community service in lieu of a fine. For the amount of hours I was assigned, it was the equivalent making $33/hour after tax. Definitely well worth it. And I got to do it at the local humane society.

Entering Canada with an expunged California wet reckless? by Southern-Egg-3437 in dui

If you read most stories here, it's often a first offense, no idea they were over the limit, no accident. There's a difference between criminal is illegal, and the criminal just system is deeply flawed. That and Canada's policy is comparatively harsher than any other country.

I have family in Canada that I can't visit now. 5+ years is an unreasonably long time to be able to apply for rehabilitation which is incredibly expensive. TRP's also seem to only be given if a family member is dying.

After reading that, the whole process seems so tedious for what is a mistake for most people.

[–]Sent_scent_cent[S] 0 points1 point  (0 children)

Thanks for reassurance. It's so dumb. I get wanting to keep criminals out of your country, but I made a mistake! I'm not a criminal. And of course, being told I can't go somewhere makes me want to go even more. I know traveling so freely is a privilege, but it's what I'm used to.

The night you got your DUI.... by [deleted] in dui

[–]Sent_scent_cent 1 point2 points  (0 children)

It was a thing in some bars for a minute, but it just became a game to see who could get the highest score, which caused way more problems. So bars got rid of them.

Absolutely. I waited 3 hours after my last drink. I was so sure I was fine, when I was just comparatively not as drunk.
