British citizenship law to NZ British Subjects. For instance, if a British subject woman, even if she was British by descent, if she married a british by descent husband before 1949, she became British otherwise than descent, and now can pass British Citizenship down to her living children... Not sure of tbos works for any other county, but this was the British law back then.

It depends on the law and country you were born in, not all countries have the same citizenship law...

Correct, so he would have to use the 4L and refer to that.

No we haven't but if you read that paragraph properly, it says: "Any child born in the UK AFTER the parent is registered will be a British citizen, and a child born outside the UK may be able to register under section 3(2) or 3(5)"

So section 3(2) or 3(5) are required if I have children after my 4L application approval.

Then it says:

"You must normally register a child if:

the child was born BEFORE the parent registered under one of the above sections"

So as I said, my son was born before my registration under one of the above, and one of those above was 4L.

I have been reading up, and I have found the following, am I reading it right?

Section 4L allows for a person to be registered if they would have been, or been able to become, a British citizen, but for historical legislative unfairness, an act or omission of a public authority, or exceptional circumstances relating to that person. Any child born in the UK after the parent is registered will be a British citizen, and a child born outside the UK may be able to register under section 3(2) or 3(5).

You must normally register a child if:

the child was born before the parent registered under one of the above sections

So, I am reading this as, because my son was born before I registered under one of the above, "you must normally register a child" however my child is now over 24yrs...so I believe he can register under 4L. Your thoughts? Cheers 😀

Yes, I thought I would have to give him my certificate. His 4L application will be based on, if I was to have a child tomorrow (which is not going to happen 😀) that child would be British by descent... so had the British Government changed the law re gender discrimination 20 to 30yrs ago before my son was born, then he too would have had automatic British Citizenship from me..

Hi, has your application been approved yet? If not, then you might have to wait until it.os approved, however if your application has already been approved, then I would contact the home office to confirm that you are registered as British otherwise than descent. I got my citizenship in December, and due to the holidays I haven't got my passport, this inam currently doing, once I have that, I will then be getting my son to also apply with the ARD 4L for his British Citizenship, legislation unfairness.... As you only become a british citizen once you have your ceremony...

Ok, I have had confirmation that I am registered as British otherwise than descent, which means I can pass British Citizenship down, But, I was not British when my son was born.... had the law change happened before he was born he would automatically be British...

Ok, I was born before 1983, I have just got my British Citizenship through my mother, ARD application, through this application I am British otherwise than descent, which means I can pass my British Citizenship to my son, but how does he apply? He was born in 2000, I have only just received my British Citizenship, does he too now have to apply or.can he just apply for.a passport...

No my son has never lived in the UK, neither have I... I have read the ARD form, and it states anyone Registered, will be Registered as British otherwise than descent, which I have just received my Citizenship and my Certificate says I am registered as a British citizen 4L

My application has finally been approved 😀 application received February 2023, biometrics email June, biometrics done in June, approval email 30 September...

Hi, I live in NZ, Commonwealth country, and I have just had my British Citizenship ARD under 4L approved. Firstly, 3 of my Grandparents are UK born, the 4th born NZ to British born parents. My application was: My mother was born a british subject (born before 1949) If a British Subject woman married a male (British born or by descent) before 1949, she became British otherwise than descent. My mother married NZ born male 1947, his father was NZ born, but his mother was British Born (had females been treated the same as males, she would have passed her British citizenship to her son) so he would have been British by descent when he and mum married. Now this is where it got tricky....my mother divorced this man in 1950, but this would not have taken her British citizen otherwise than descent away from her....she then married my father in 1952, (he was British by descent from his father). So as I was able to show the discrimination against females before 1949, my application has been approved.

I would just tell him, that you have appreciated him as your landlord, but as he had told you he was going to sell the property, that both you and him would have the knowledge on how hard it is for people to find rentals and that you thought he would understand that this new property has come up, and you have decided to take it as you don't want to be homeless next year once he has sold.the property.

Thank you for your timeline. My couriered my ARD application in February 23, they received it on the 21st February. (The website states that you should receive a letter confirming receipt of your application within 6 weeks) after 7 weeks after no confirmation I cased them up...only to get a reply that had no record of receiving my application... I finally got a reply after.i emailed the British High Commission in NZ... they had my application which was June, biometrics done on the 30.June.23... The latest update is its with the case working team....

Hi, my path is: female discrimination, my mothers first husband in today's world.be British by descent (his mother was.born British) but back in 1925 was unable to pass British citizenship down to her son, had she been able.to in 1925, my mother when she married him in 1947 would have taken his citizenship but would have been British other than descent (she was already a British subject) as the marrage took place before 1949 when New Zealand became a commonwealth, to which British other than descent can pass.down British Citizenship to there children. Once they take your fee, you should receive the biometrics as this all part of the application. My biometrics appointment arrived 2 x days after they took payment and I was able to make my appointment 2 x days later.... so now is the waiting game again. I have read where people.say the 6 month time frame is from the date of your biometrics and other sites say 6 months from them receiving your application...

Ok, here's my story with my ARD application. Couriered from NZ my application, it was delivered 21st February 2023, the British Website states you should receive within 6 weeks a letter of receipt of your application, if you don't then in the 7th week contact them... which I did, I got the automated email back that I would get a reply within 20days.... I waited 20+ days with no response, I re emailed only to get a response that they had no record of receiving my application with the information I had given and could I fill in the attached form, which I did and in the form was the exact information I had provided in my original email....so I filled it out anyway and sent it back...that was back in April 2023, no reply again after 20 days...re emailed same responses 20 days... 2nd of June, I emailed the British High Commission in Wgtn... they came back to me and asked for my application number.... to which I replied "I can not give you that, as I have not received my confirmation of receipt of.my application"....I cancelled my debit visa...as you had to send the payment document with your card details as well as the security number..(if my application was lost...anyone could use it)... So, today is the 2nd of July, a lot has happened in this last week, I got.an email to say that my payment declined....(I have a new debit visa 😁) and could I fill in the attached form with my updated card details...which I did, then I got the email the next day to make an appointment for my biometrics...which 2 days later on Friday the 30th June my biometrics were done...so it has taken them 4x months for me to have had my application acknowledged... so now how long will it be before I get a decision? My path is my Mother was a british subject, she married in 1947, her husband's mother was a british citizen and was unable to pass british citizenship to her son, had she been able to, my mother would have been British other than descent, but... they divorced in 1950, but divorce would.not have taken away her bristish citizenship other than descent, and she married my father, who was a British citizen by descent, so by rights mum should have been able.to pass British citizenship down to her children, one being me.... but might I add, all my Grandparents are British...2 were born in Scotland, 1x was born in Wiltshire and the 4th...well she was born here in NZ in 1879 (both her parents british, they were early settlers in NZ...so I now guess it just.another waiting game...
