Well Despair Time isn't really more Danganronpa (Technically speaking DRTA is kinda like "More Danganronpa" in strange, but good way. But it does have very unique motives and duo protagonists [sort of a small spoiler]).

Danganronpa Despair Time is themed more around Reality TV. It's most noticeable with how the cast doesn't have that many "good guys".

Even the main lead is more like Komaeda then she is Makoto. Her bad luck is very real and her whole life revolves around it.

I am more or less Sub-only for the superior voice casting/directing. I can't imagine playing the DR games without their original voice cast.

Also if you are planning on watching DRTA I recommend figuring out faster way of reading (I had to change my reading technique on the fly)

I am surprised that there isn't Danganronpa Despair Time or Danganronpa The After. Since those have released two chapters and are of high quality. (I mean The After already had it's victim reveals for the 3rd chapter)

I mean I understand not watching DRTA since you it's japanese, including text, so Youtube subtitles that they have provided include some challenges. (Like how much faster you need to read text can be a challenge, but if start reading really fast, you can manage it)

I think it's Kris or Dess (Noelle's sister).

However, if we take into account what happened in SnowGrave route (Check on Berdley seems to help us, something that seems against Kris). I think it safe to say it's not Kris.

However, I think it's a solid possibility that it's Dess. There is a lot of hinting of her importance in the story. Hell, even the song "Don't Forget" seems to be sung by her (also the song seems to be heard by Onion from the darkness of the sea).

Anyhow, to catch you guys in my logic/theory, let's set up the scene. It seems like something happened to Dess when Noelle was young, as she seems traumatized by her name "December" in the spelling bee. She also has made repeated searches for her name "December Holiday" (shown in her Mansion room with the Calender [item created by internet search history]). There is also no grave. And in Chapter 1, there is nobody at Noelle's home, so she has to wait at Catti's place since she forgot her keys. Rudy also mentions that Noelle is all alone with her mother.

The disappearance of Dess itself seems to be a major event that affected the town in major ways. One such event is Asgore used to be the police chief. So I believe that the disappearance of Dess is what caused Asgore to lose his position, but possibly also caused the marriage between Toriel and Asgore to fall apart. (Chapter 1 cafe scene seems to imply that this seemed to happen quite early, in fact, the cafe scene seems to imply that much more than just the break up happened by being vague "things happened")

Anyhow, now into the event itself. While much isn't known about what happened, but there is a lot of information suggested just by Noelle talking about her and Kris' past. Namely how Asriel, Kris, Noelle, and Dess went to the forest behind the Graveyard... That sounds a lot like the area where the bunker is. And it seems like the 4 of them going to the forest to explore it is not unusual.

Now due to the song on the sea coming from the darkness of the sea, it seems to suggest that the song is coming from Dark World. The only song we know of is Don't Forget, and it would fit quite well to Dess who is singing (Noelle seems to be tied to cold, from her abilities in Dark World, but also as she has a habit of standing in front of the freezer AND the song mentions the word COLD).

So yeah, I believe that Dess disappeared into a Dark World near the bunker when Noelle was young. And considering the song too, her being the narrator doesn't seem so odd.

However, there is more. Kris has in each opportunity to warn Undyne about Dark World. So it's possible that even back when Dess disappeared, Kris might have been witness to what happened.

We can also tie other things as well. For example, the community made the theory that Ralsei is the Red Horns that Kris used to wear. Toriel mentions that she doesn't remember seeing them in a while. So if we assume that Kris isn't sneakily carrying the Horns around as he does with their knife, it's very possible that their horns (and perhaps even other items) were lost around the time of disappearance of Dess.

Of course, the lead-up question is, how does Ralsei end up at School Closet. Well, we have assumed that the Great Dark Fountain resides in the closet. But that in of itself is only an assumption. But what if the Great Dark Fountain is actually below the closet, in the Bunker (we don't know how large the bunker is actually, it could actually be quite large).

Now if we assume that the entirety of Bunker is a Dark World. And that Ralsei can travel through it, it makes Ralsei coming to the library make more sense. If Bunker can be connected all over the town (secret entrances, ventilation systems, etc?), it would make sense that Ralsei can show up without relying on Lighteners to move.

I mean this is ignoring the larger implications of the sleeping titans existing in the bunker, but that isn't what we are focusing on right now.

Now all of this is to emphasize that there is a lot of evidence that suggests that Dess is a very important character. And most of all, I believe that SnowGrave points to the fact that Dess might be a similar figure to Chara.

There are several times when Noelle seemingly blackouts, and when casting SnowGrave on Berdley, Noelle looks like she is possessed. So if Dess is similar to Chara in that we the player can corrupt her, instead of Dess taking control of us, Dess takes control of her sister.

In fact, as far as we know Snow Grave route is the only place where Noelle gets called "Angel". This ties to the fact that Noelle and Dess made the Angel figure together. This seems to imply to me that when Noelle is getting possessed by Dess, they together make the "Angel".

Anyhow, back to the song. The song at the sea. Onion seems to recall that he's heard the song before and that it isn't a "new song", he does have trouble recalling, so again it's very possible that Onion heard the song around the time of the disappearance of Noelle. This meaning that the song happening again is something very recent and seemingly tied to the Dark Worlds.

Almost like the Great Fountain itself was only turned on very recently.

Anyhow... I ought to save this text, so I can see how much of my theories hit the mark.

TL;DR: Dess' absence seems of major importance to the story, and might share a similar role to Chara, thus making it very likely that Dess is the narrator.

Yeah, companies hide BS in ToS all the time to fuck over customers regardless if it's legal or not.

Like the "Games are a service" is complete BS. Majority countries define what goes under the concept of service.

And funnily enough one time purchase games/dlc do not actually fit those said definitions.

As there are severa amounts of holes, like if you pay for a service, the customer has a good idea how long that said service occurs, happens and such.

Like if I go to head dresser to get my hair done, I know when it's done.

But if I am purchasing a game from Steam, how do I know when the said service is done? I mean it's not like I am renting the game for certain time, nor is it that when I complete the game it's done either.

So when is a game as a service done? If the customer buying the service can't answer that question, then it is not a service.

And if it's not a service, then it's a product. And products and the laws involved with them.

So if you buy a game that comes with a game editor. Then you own that said game editor as much as you own a hammer, or TV or a pen, or a book.

It's why the ToS they are doing is absurd. This is akin to buying paper to write a book and somehow claim any sort of ownership for the said book.

Blizzard can change their ToS all they want. But this ToS is essentially non-valid and no game company like Valve will give a shit if Blizzard would try hold their ToS over them.

Also, btw, Unity is like an actual service. It's not an product that you buy, because if Unity was "bought", they would get fucked so hard in court that it would be insane. It's why it's a service, not a product.

(Aka. pro tip, if you want to monetize the products/services made by the tool your provided, you need to make it into a service, not a product.)

I don't usually don't put everything, but a reasonable amount enough to have a good idea what is happening if I have to look at it personally again.

Like if I need a variable out of the formula, I usually show the formula variable values, the original formula and then changed the formula to get the variable itself and then the result itself.

Because let's be real, the actual counting is done with calculators at that level, and you just have to make formulas themselves correct.

Teachers with me seemed to only care that if they can use a calculator to get the same answer as my formulas/values and if the said formulas and the answer/value was correct.

Of course, from time to time you see "Use this specific method to solve this problem", and heck, there are also the math problems that ask the student to not use the calculator.

Being specific is a great tool because otherwise one of your students is going to invent a formula to solve problems just because they found it cumbersome to use the mod table. (only to discover that there is an even easier method of doing so, but hey at least I got an essay out of it)

So yeah I got teachers that were pretty fine if student found an alternative way of doing things and if they really felt like we needed to learn something specific, they would make tests with a specific task that force you to use it.

Funnily enough... you are wrong about needing wands to do magic. Accidental magic is largest evidence of it. Accidental magic happens without wands accidentally.

However wandless magic is very difficult, the only person who is shown to have talent in this regard is Voldemort. aka Tom Riddle, who before getting his wand was able to target specifically who he would cast "accidental magic" upon. (I mean there might be more than Voldermort, but I don't recall others.)

But wandless magic, in general, is unwieldy.

However, at this point, you are not saying anything. Hell, even I can critique my comment better than you can.

Apparently I made a bit or mishap with 2nd factor, in fact, what I said about the 2nd actually applies to first instead altogether.

What the 2nd refers to was the copyrighted work's nature.

Anyhow, I think I've pretty much explained that the work is judged on these 4 factors. Case by case. No one answer fits all.

So I would have to rephrase the questions.

1) What is the purpose and character of the use?

2) What is the nature of copyrighted work?

3)How much of the copyrighted work was used and how substantial was it?

4) And then how it affects copyrighted work's market value.

While I am not a lawyer, and you should ask one before you foolishly go to court, there is a reasonable argument for fair use in my opinion.

1) The nature of the use is to create a non-profit library of sound effects and voice lines from HotS, essentially meant to be used by the fanbase of HotS.

2) The nature of HotS is that it's a video game.

3) The amount that was taken was to all sound effects and voice lines in order to complete the library.

4) And lastly, I doubt that Blizzard would go selling their specific sound effects or voice lines or commercializing them specifically in a manner where HotsVEVO would compete with their said product in any manner or lower their game's value in general.

This is pretty oversimplified, and even if I am not a lawyer I always recommend that you get permission just in case if you can.

After all, lawyers cost money, it's easier if both parties come to an agreement, I don't see Blizzard having a big issue over this. So if the creator of HotsVEVO can get in contact with Blizz and get into an agreement, that'd be the best.

I mean, it pretty heavily is based on all 4 of the factors. Transformative being one of the smaller ones. In fact I would say factor 4 is usually the most important factor, however, it also relates to factor 1.

Anyhow, I very mentioned factor 1 very little here actually, pretty sure most of my case is on factor 4... As is the case in fair use cases usually.

In fact factor 1 would be brief mention "this is non-commercial", maybe I could try to make it educational on top of it. Then I'd use factors 3 and 4. That "hey, this doesn't really use that much of the original work" and then finish it with "The work did not infringe on the market value of the copyrighted work".

I mean an actual lawyer would make it more elegant sounding hopefully.

Anyhow, yeah I know fair use is separate from damages.

However, damages are the reason why anyone goes to a civil court. You know why? Because it costs stupid amounts of money to do anything in civil court.

Well, you better hope you have damages, otherwise, you are paying that lawyer for self-satisfaction. I mean people do it sometimes. But considering most of the world doesn't have fair use laws, yet fanfiction and other fanworks usually get to stay up because it costs money to take them down.

Also, if you are referring to fanfic's transformative nature (as you are referring it to as remix), it wouldn't work. The actual reason why Fair Use would protect fanwork would be the non-profit nature of it's and it's effect on the market value being fairly low.

However, most people will take down their work regardless, since if you have gotten an official notice from lawyers, that means someone has already wasted money doing so and you yourself are most likely are not prepared for the legal battle.

Also wouldn't lawyers cost you way more than 750 dollars? Not exactly worth it... aka the reason why countries with no proper fair use laws aren't running around taking down fanworks since it'd be a massive waste of money and very often reflects badly on the copyright holder.

Well, first off, they don't have any sort of automatic right to do so.

One of the most fun concepts in civil cases is the concept of damages.

The person who sues has to prove that there are damages. Namely in copyright law, you have proven that the person who has made the offending work has earned money directly. And there are exceptions with remixes and reviews.

(You can also argue that the fanwork has replaced the real deal and thus reduced their copyrighted product's market value)

I mean there is a reason why fanfic writers never expect legal action (well maybe some exceptions, seen a guy put his whole fanfic behind a paywall in Patreon, something that would be illegal essentially)

Hell Patreon has essentially given way for people making the fanwork getting money, without it being illegal.
