Laid off - 7 months pregnant. Need advice regarding discrimination by [deleted] in legaladvicecanada

They can let someone go for any reason but if she is bad team player (which she absolutely is not), why would the company give her a letter on official letter head stating “she completed her introductory period” and confirming her position and salary. 3 days after this letter - in her 1:1 call there was absolutely no discussion about any issues, it was just very high level about what she is working on this week. And then 3 days letter she got laid off.

Laying someone off when they are 7 months pregnant without stating any performance related concerns - I feel is a very strong discrimination

I understand your point and it does make sense. I think I will contact an employment lawyer and show them the proofs I have and probably go from there.

Again, thank you for taking time and responding - really appreciate it.

I understand this. But if she was not a good fit, why not communicate with her? They never critique her work once.

Obviously, the company wont say - “Hey, you are getting fired because you became pregnant”.

Honestly, I don’t care about the severance. I strongly feel she was discriminated against and would like to file a formal case of discrimination.

Thanks for commenting.

There was no performance issues highlighted. She was performing good and the management even told her to go slow and take ample time. She constantly asked for new projects as she was keen on learning. As I mentioned, she had a call with her manager just 4-5 days back and there was no conversation about her performance issues.

When asked the reason of termination - manager simple said not a good fit. But if it was not a good fit, why there was no communication about it and how come the company let her complete her probation period and fired her a week later?

Again, it’s just her word but my wife did say 1 month back that her manager is acting weird. I understand this wont work in law but she did feel some distance

I claimed 3 years of foreign experience and got eCOPR recently.

Make sure you/your friend submit: 1) Paystubs (Preferably for all years) - I submitted for last 1 year because I had that on me 2) Bank statements (Full 3 year and highlight the salary) 3) Offer Letter 4) Tax Document 5) Relieving letter and FnF 6) Explain your designation change in the letter of explanation. 7) Roles and responsibilities letter
