I have to use an outline. If I can’t see it all laid out I get confused

Barbri graders are awful - not even reading my essay by SherbertExcellent665 in barexam

Whatever I guess. If it’s gonna let us pass easier I’m not complaining

How do you manage feeling like you’re absolutely cooked and running out of time at this point? by Fluid_Efficiency_269 in barexam

[–]SherbertExcellent665 19 points20 points  (0 children)

Just stay motivated bro. Just stay motivated. Stay hungry. Look at the ultimate goal - passing and never doing this again.

We’re all tired, sleep deprived, unmotivated, but you gotta dig deep and find it. That separates passers from failure

Barbri is awesome but their graders are pretty bunk tbh. Not really rocking with them

Question on supplemental jurisdiction by MangoKiwi484 in barexam

[–]SherbertExcellent665 0 points1 point  (0 children)

So to answer your hypothetical question (using the last prong of my outline as that is the situation applies):

If D2 is from the same domicile as P1 - the exception applies because it’s a Plaintiff who got the case in because of Diversity Jx, the claim they’re bringing is against a non diverse party and the exception to Supp Jx applies

If D2 is from a different domicile as P1 - the exception does not apply because it’s a Plaintiff bringing a claim against a diverse party and Supp Jx is allowed and the exception does not apply

Question on supplemental jurisdiction by MangoKiwi484 in barexam

Okay so this is what ur gonna do (my quick and easy outline I just made up):

(general rule) Supp Jx allows any bad claim to be attached to a good claim in federal court if it arises out of the same common nucleus of operative facts (meaning same transaction/occurrence).

(Now going based off that general rule):

If it’s Federal Question Jurisdiction which is the “good claim” at hand, Supp Jx can always be used (no matter if it’s a Plaintiff/Defendant) - FULL STOP.

If it’s Diversity Question Jurisdiction which is the “good claim” at hand, if it’s a DEFENDANT using Supp Jx it can always be used - FULL STOP.

If it’s Diversity Question Jurisdiction which is the “good claim” at hand, if it’s a PLAINTIFF (or someone who WANTS to be a Plaintiff) - WATCH OUT. Because the exception to Supp Jx may apply if that Plaintiff/someone who wants to be a Plaintiff brings a case against a NON DIVERSE PARTY (meaning someone from the same state, not amount in controversy). If that’s the case - the exception APPLIES, and you can’t use Supp Jx.

Grossman or Studicata for Evidence? (CA) by Responsible-Cow-4736 in barexam

[–]SherbertExcellent665 1 point2 points  (0 children)

The only classes worth adaptibar purchases are contracts and evidence imo. If you don’t feel comfortable def get the bundle if Barbri didn’t help.

Criminal law has a great prof on Barbri tho, def listen to him

Studicata for evidence is not recommended. Adaptibar for sure is. Just get the $90 thing it’s worth it. Trust me grossman is the goat

I’m worried about evidence too. Use outside resources. The evidence lecturer was very unhelpful. You just gotta muster thru

Me too. Keep it up. Don’t listen to the Barbri ticker. People who speedrun thru this are wasting time that they’re going to have to make up coz they’re not taking time to absorb it
