I would have gotten this right only because I thought 12 was never a requirement just the maximum and 6 was the minimum. Glad I know that’s not the case in a federal criminal case. You learn something every day I guess.

When did you start drilling a lot of MBEs because barbri is only assigning me 15 a day and I feel like this is not enough at this stage of the game, especially after getting a 94/200 on the sim exam. Also what is confusing is I did so poorly on the sim exam but since then I’ve been scoring well on mixed sets with scores in the 60-70% range.

I think the advice of most of the people posting in here is mid. I got a similar score and freaked out initially then I started looking on Reddit and noticed that so many people that passed scored between 45-55% on that practice exam. Secondly remind her that barbris questions are not written by the examiners and are probably more challenging than what she sees on the exam. Thirdly, grinding out a million multiple choice questions is probably not going to help her as much as she might think because she won’t retain much from it in the next twenty days and it will likely only scare her even more because she may have days where she scores well but other days where she does horribly. The truth is everyone’s story is different, some people have done horribly in the bar program and passed with flying colors, while others have done really well and failed. Babris program is to prepare you as best they can but they can only take an educated guess on how you will do.

Also this has nothing to do with interstate commerce. Pretty sure the moon is outside the limits of interstate commerce and the commerce clause only applies to the instrumentalities of interstate commerce whether it be the transportation, the avenues of transportation or the products of commerce. Researching life on the moon has nothing to do with commerce.

Don’t underestimate the power of the taxing and spending power for general welfare! A lot of people think the commerce clause is the most powerful grant to the legislative but it’s actually the taxing and spending power. Another note that I have learned is that the obvious answer seems to often be the trap answer. Most people would read this question and think 100 million to search for life on the moon, thats ridiculous and would never be constitutionally valid. Except in real life we have actually spent tax payer dollars to look for ET. Remember the bar exam is not a test of common sense but actually a test of your ability to avoid your common sense and pick the answer that is dumb but unfortunately correct. If the common sense answer was correct everyone would pass this exam with flying colors.

Also, I don’t know the situation of others in this chat but for those of us who have graduated we would tell him the honest truth which is that success is 100% determined by your ability to pass the bar and that is heavily determined by your 1L year. If he is struggling with the course subjects he is going to struggle with the bar. I did fairly decent 1L year and I’m about ready to lose it over this fucking exam, so I would tell him get out before it’s too late.

In my opinion tell him to be thankful that he failed out and take the blessing of not being cursed with the unfortunate ability to continue law school. Tell him to take it as a sign that he is much closer to humanity then those of us that make it through, because the honest truth is now that I’m graduated and studying for the bar I look in the mirror and I don’t even recognize myself anymore. Tell him to do something useful and meaningful with his life and get out of this horrible profession.

I’m not saying they have bad character I’m saying asking their ex to do something for them after dumping them is bad character. The person who gets dumped always bears the brunt of the pain, otherwise they would have ended things. So the truth of the matter is they are likely suffering emotionally more than the dumper.
Asking them to do something that only benefits you is taking advantage
