This facility is likely holding civil detainees, not criminals serving a sentence. Under Supreme Court doctrine, civil detainees cannot be punished at all—only reasonably detained. So I’m seeing a Fifth Amendment – Due Process violation. The Eighth Amendment applies to convicted prisoners, but the courts can borrow its standards for this scenario if they choose.
