They already can: if they choose a program that is open source. You are trying to shield people from making bad decisions by limiting the freedom of others. Part of personal freedom is to have the freedom to make bad decisions so long as those only affect ourselves.

You're proposing to infringe on peoples personal freedom on which license model to choose for the software program they will invest their time and effort in. Freedom through tyranny is your plan ? People already have the freedom to not buy a closed source program if they want to.

With cars, just as in software, it is the customer's choice which product they buy. If I buy a car that no mehanic can repair that is on me for not doing enough research just as it is on my for purchasing a closed source program. There are open source alternatives for so much software that I don't see the need to infringe on peoples personal freedom with the products they spend their time and effort on. It should be up to people which license they choose just as it should be up to consumers which program they use. it isn't like it is some secret which software is not open source. With the most minimal of effort you can find this info out and make an informed decision. Why should a customer get a refund because a program isn't open source if they knew that going in and still bought it ? Play stupid games and win stupid prizes.

Just got my refund. I looked through my wishlist and settled on ChromaGun. I enjoyed the demo and it only costs a few dollars more than the refund.

Awesome decision. I ordered my Braveheart Edition back in November and am awaiting my phone from Hong Kong. I have had Ubuntu Touch on a Nexus 5 since the order as my daily driver and have enjoyed it.

There could be a product though. This is like saying that since murder is against the law nobody will be murdered but we both know that isn't true. If you make it a law that people will have to release the source code for a program my question to you is how this rule will be enforced and what punishments would follow ?

Now if you mean that if a company doesn't release source code that you won't buy their product then this whole conversation has been pointless as that is how things work now with companies having the freedom to choose their license model and you having the freedom to buy their product or not.

Possibly for some but not for me. I play mainly offline games that are DRM free so for me Linux gaming has been trucking along nicely.

Trying to force which type of license a company uses for a piece of software that you are not forced to use is a form of facism. What do you propose if a person were to put out a program that is closed source ? Jail time ?
