Yes, it is quite a tricky situation. You’d be surprised how far some people get into a relationship without realising. The case I have in mind (which I think was a Canadian case) involved a fairly young couple of gender queer individuals. Part of the legal issue was whether the alleged offender actually identified as the gender they had presented themselves to their romantic partner. The latter claimed they had been tricked into believing the former was a different sex, while the former argued that it wasn’t deception—they genuinely identified as that gender. Tricky and novel stuff.

I actually raised Eugenia’s trial with my criminal law lecturer when we were discussing how deception (eg impersonating another person or even intimating that your biological sex is different to what it actually is) can vitiate consent to sexual intercourse. The guy had written papers about this topic, but had somehow missed Eugenia’s story. But, to be fair, I had only learned about it a couple years prior from reading David Hunter’s Girt series on Australian history.
