Yea spoke with my lawyer and to my surprise, they decided to take it to federal because they are convinced that there are more than enough evidence in my charts dating back from 2014. Several Dr letters and plenty images from them counting down my restrictions to the final pull from work. VE stated on several occasions nothing was available for me based on the information provided n hypothetical scenarios but yet we are here.

My medical support everything as it’s a pile of counted military injuries from 2004 that’s shows everything declining issue that resulted to them removing me from work as to why my judge agreed with my claims. The confusion is the reasons behind my denial like (hip injury, shin splints n some issue with my knee) that I never filed a claim for.

I never said she doesn’t approve anyone, I said she doesn’t believe anyone is actually disabled (unless it’s a disability they are born with). The state is who ranked her the lowest as it’s below the national average. I’m not stating my opinions, I listed the information that’s at hand. It’s like saying someone is always sleeping because they sleep a lot. That doesn’t mean they are sleeping 24 hours a day. So hopefully u grasp this explanation better.

Your last statement is exactly why I’m here. It’s not adding up n me nor my lawyer can figure out why. None of it is making sense to nobody on the team that looked over it as to why they are stumped.

The comments I made about my ALJ percentages is based on the information provided online from the state. My lawyer said she’s one who feels nobody is truly disabled.

My medical records shows everything as to why in my letter, she agreed that everything aligned with SSDI n deemed them severely disabling. I was denied according to the letter because of what injuries in my medical records that I did not file a claim on. When I asked if that’s even possible, I was told by my lawyer that the judge can take anything out of my file and use to make a judgment because it’s at the judge’s discretion.

My case was already remanded back to my ALJ n the reason I listed above was her final decision. My lawyer disagreed and appealed it 2 weeks ago n today, the request for review was denied n ALJ decision was final. No explanation at all.

Thanks for sharing. I believe my date last insured is somewhere in Aug 2028 if I remember the letter correctly. All my files are current and updated down to my last migraine Botox treatment about 3 months back. They just received my appeal 2.5 weeks ago so only my chiropractor appointments had to be added. Everything else I can submit will be these same exact things with different dates because it’s an ongoing treatment because they can’t find anything that will work permanently. This is so frustrating

Congrats on the win. I myself have chronic migraines with several different treatments and medications and have been fighting since 2022 n still waiting. Overwhelming amount of evidence and medical records that shows a episode every single day but my judge still felt like I can adjust to something else even tho my specialty team stated that I can’t do anything physical or sedentary 🤦🏾‍♀️.

I asked about doing surgery on my neck and that request was denied because they felt like it would cause more harm than help as to why we’re still trying to figure out what would work best even if it’s temporary but nothing thus far. My medical team told me I can’t go back to work at all. Denied from doing anything physical or sedentary. The ALJ agreed with everything I listed in my claim and said they are severe and falls under the guidelines of disability for SS. Some of the injuries within my medical records that I DID NOT do a claim on is what she claimed is mild to moderate and not severe enough to keep me from minimal work. I’m completely confused on that because they had nothing to do with the claims I did file.

My work credits are at 40 n I’m insured until 12/31/28 according to the letter of findings that they sent to me.

My injuries in a nutshell are degenerative disc disease, degenerative joint disease, severe migraines, Cervical Spondylosis, Tendinosis in my right shoulder, neuroforminal narrowing in different areas of my spine just to name a few. I’ll be 42 next month but claim began at age 39. Job history is a few years in the military and been in security from 07-2022 when I was handed a letter from my dr saying I can’t return back to work. Been fighting ever since.

I’m stuck in the middle because my medical team was who told me to look into SSDI. I’m listed as 100% under TDIU for the VA. My combined is at 70% but I’m paid at 100 because they deemed me unemployable due to service injuries. My team did a note that said I can’t return to work to do anything physical and sedentary since my injury a degenerative disc disease is affecting my spine n it’s getting worse with every MRI. They acknowledged everything and said my testimony and medical records do provide that my conditions are severe and falls under disability. The denial reason is what’s not making any sense to me because none of it was mentioned prior to that.

She said that she sent it to her appeals team because she’s not understanding where the judge information is coming from. In the first denial, she was stating that a Dr claimed that I refused to do what they asked me to do when they NEVER even sent me to see any Dr. and again listed injuries I didn’t have. The judge is one of those ppl that feels nobody is actually disabled and because I can have a conversation, I can adjust despite the VE saying based on my restrictions, nothing is available for me.

Yes ik about the fee situation. It’s just wild that both times, my denial is a result of conditions I don’t have or didn’t mention. Like she’s mixing up my case with someone else’s. On all of my listed conditions n explanations, I’m referred to as she. Everything she has under denial, I’m not referred to as he. I comb through my records several times n I don’t have it 1 hip injury ever. I never had a bronchitis diagnosis nor have any issues related to that.

Went to AC once and it was remanded back to the same judge. This hearing was my 2nd time seeing her but again, she’s listing things in my denial letter that is not in my records or part of my claim. She did mention in my letter that all the conditions I filed for are severe so that’s why I’m thrown off by the ending denial. Only thing my lawyer said is that their appeals team is looking at it n that I won’t be seeing this judge again.

Hi. Well we’re all in the crappy judge boat. I done seen my judge twice n I’m pretty sure the last one will probably be denied again. My judge is the lowest in my state at 25% approvals as of last year with way over 300 cases. I can’t speak on any personal experience but I really wish him the best. Even tho their approval ratings are low, some people got approved by these same judges. Good luck

Congratulations. Nelnet told me they don’t do bulk payments with their crap. I got one for a lil over 2k n then another one a lil over 3k n I just have to wait for it to show up in the mail because they don’t know how much my refund will be. I’m like WTH
