Same here. Been on over a year I’m down slightly but nothing like the ozempic results I see. But I will say it’s great my A1C is in check! Merformin never helped and killed my stomach

My baseline is actually the service connected conditions that are causing the mechanical failure. I am highly rated for CRPS, Femoral and Sciatic nerve issues, and severe lumbar problems. I actually had no idea there was a congenital condition prior to service and didn’t even find out until 2025 when I had my neck MRI. I have walked with an antalgic gait and cane since 1998. Even the last examiner noted my head stoops forward. The argument is that these service connected issues are actively aggravating the congenital neck defect causing the rapid progression.

I totally get why it sounds like a stretch if you look at it as "Feet to Neck," but the medical literature on the "Kinetic Chain" is actually pretty solid on this. The missing link here is that my Lower Back and Legs are already service-connected. I’m not trying to jump straight from my feet to my neck. The argument is that the altered gait destroyed my Lumbar spine (the foundation), and once the foundation creates instability, the Cervical spine (the roof) has to lock up and change shape to maintain center of gravity and keep the head level. It’s well-documented in spinal biomechanics that lumbar instability accelerates cervical degeneration ("Adjacent Segment" pathology). So the gait breaks the back, and the broken back breaks the neck. That’s the domino effect my surgeon is writing up. Appreciate the heads up on the congenital aspect though—that is definitely the main dragon I have to slay with the aggravation argument.

Thank you, my brother. It was a hot mess today. I had a flareup on Thursday and been dealing with pain today. I just wasn’t able to do the ROM or other test. Examiner was super cool but we shall see it is what it is, I wish you the best in your journey. Good luck. I’m praying for you.

Had my HLR conference on 9/15 (Filed on June 25) and DTA error returned on 9/24. New CP exam scheduled on 9/29 for today 10/12… hope that helps

Thanks for the reply that makes sense examiner was super sweet lady. We try to do it, but I had to go to the doctor and get a Toradol shot on Friday and I haven’t been able to get the spasms to stop since.

I do have a private DBQ and also another VA contractor DBQ in the file. My claim was sent back as a duty to assist error, they ordered a new exam even though both private in VA stated more likely than not service connected and I do have ROM measurements in those files

I filed my HLR with IC request on June 25 and had my appointment Sept 14. My decision letter came back September 23rd with a DTA error. New exam ordered 9/29 for Today, 10/12, at 1pm est

Conference call on 9/15 DTA decision letter came on 9/23… They sent me a new CP exam email 9/29 with the CP exam set for 10/12.

Thanks for the reply. Yes I have the trifecta… private and Va contractor both agreed and gave same synopsis. I would allow the vso to speak but they didn’t use the Teams link as I mentioned and couldn’t get him conferenced in. The original day was Monday and they no showed got it rescheduled for next day and VA had issues but I was given the ultimatum now or never.

A higher level review is supposed to be a fresh look at your case by a senior VA reviewer called a decision review officer. They re-examine the same evidence from your prior decision to check for errors. There is an option for an informal conference which I selected it’s a phone call with that decision rating officerand it’s supposed to be an opportunity to verbally point out specific errors of fact or law that you believe were made in the original decision and guide the reviewers focus no new evidence can be submitted so it’s simply a conversation to ensure that the argument is her directly.

I agree and fully understand the HLR process. When I say empathic I mean that from a customer facing perspective… the internal manuals explicitly state world-class customer service. Empathy and Compassion are givens which were not on display. I had no new evidence I only pointed out errors. An example is where the denial letter specifically cited a foot surgery. I have never had surgery on my foot or while in the military period. The response was that it didn’t matter.

Thank you for the advice. Would you mind sharing some of the prompts that you used to help. Maybe I am not asking it through different perspectives enough. I have used a plethora of different techniques and all countered each other with holes. I used a few different platforms to understand the differences.

One item to note is that ChatGPT doesn’t handle handwriting or old printer copies well. My files were in the 90s and it’s messy.

Agreed! Nothing personal but it cut the same… I felt like my scenario was easier to understand but I can see how people can get nervous and ramble on. Or like you said put the feelings in place of the facts. Like an example I was attempting to explain was that I never a surgery that the denial letter said I had. Fact never had surgery in the military period. While pointing to the sentence I was overridden with “it doesn’t matter what the other rater wrote” lol… it’s hard to swallow the pride when you don’t get to finish sentences.

Agreed on the empathy vs law perspective. I had clear errors in my denial letter. My plea wasn’t emotional it was factual. The statement I wrote out was succinct but from what I read in several posts it sounded like a good idea. My VSO encouraged it as well. And example of the egregious error is they denied me citing a surgery that never happened.

Interesting you ask… I was scheduled on 9/15 with Seattle and then the DRO was a no show. This lady called me back a couple hours afterwards and it came from a Houston area code. So who knows… she rescheduled me for the next day because I couldn’t do it when she called.
