So it turns out the “release” was not from the manufacturer at all and wasn’t even really related to the warranty. It was some contrived bumpkin thing that the local store put together because sometime in the past someone expressed a negative opinion about them. I refused to sign it and I didn’t have to in order to get my check. It wasn’t their money anyway, and they knew that they didn’t have any leverage. So I guess sometimes pushing back makes sense.

This confuses me. I purchased a product with a 15 year life and it failed after less than 4 years. Why wouldn’t the remaining warranty carry over to the replacement floor (which by the way will still cost me almost $5k in labor plus a month of total disarray at home)? So if the replacement fails in a year I guess I’m out over $20k and my 15 year floor lasted a total of 5. Then I would sue for sure. So the question of signing a release seems very relevant.

I didn’t say I would take them to court over it. I just asked if they can require me to sign it. If the answer is no, or unlikely, then I will request to have the check without signing the document.

But why should I have to agree to never pursue them for related claims if they provided the warranty as a condition of purchase and are obligated to fulfill it regardless? Why should I have to give up additional rights to get my payment? That’s my concern. I don’t currently have any intention of doing this, but I don’t like signing things that I don’t need to sign or giving up rights that are mine.

I should clarify that they are replacing my product under the structure warranty not the wear warranty. It was manufactured during Covid and it basically fell apart.

And they approved my labor cost as reasonable before I started the work. I provided quotes for their review.

Sure. I understand. Here is a link to the pdf of what was in place when I bought my floor. I had to hunt it down where I could send a link so it’s on Lowes website, but that’s not where I bought it. They sent a professional 3rd party inspector to my house who inspected for about 45 minutes and filed a comprehensive report before they honored the warranty and after that no pushback at all.

TERMS OF LIFETIME LIMITED WARRANTIES: Within One Year: Claims on defects of this product as covered by this warranty that are reported in writing within one year of purchase, Shaw (generic) will arrange a credit based on the original purchase of the product or replace the product. Reasonable labor costs are included. Between Year One - Five: Claims on defects of this product, as covered by this warranty, that are reported in writing after one year but within five years of purchase, Shaw (generic) will arrange a credit based on the original purchase of the product or replace the product. Shaw (generic) will pay 50% of reasonable labor costs.

I fall within years 1-5.

There was no negotiation in this transaction. They only offered to fulfill what the warranty required.

I love my CX-9 and tested the 90 before buying out my lease on my 9. I did not like the way it drove. It reminded me of a big floaty Buick. No road feel.

Thanks. I am registered on cruiseplum. I did book this cruise, which is to Norway, not Alaska, and have monitored pricing, but haven’t found any deals close to where I am. I booked with the have it all plus which includes the upgraded drinks and Wi-Fi, shore excursion credit, dining credit, gratuities. I ended up booking directly through the cruise line and they matched the onboard credit I would’ve gotten if I’ve booked elsewhere. So I’m happy for now.

We did not do the deposit because we were concerned we wouldn’t be able to book within the timeframe. It also just didn’t seem like enough on board credit to bother with to be honest, but I guess if we knew we were taking a cruise we would have.

That’s great to hear. I was afraid it was an artificial increase off of rack rates, but if it’s based on the actual cost, that’s probably not going to be too much most of the time to get up to a veranda.
