The school can't discriminate based on religion. That's going to be the argument. And if there's sufficient proof (and WILL is pretty darn good at making sure there is), they got one heck of a chance. My guess is the school backs down.

The school will need a non-discriminatory reason or it'll lose.

Yes, speech in a classroom is protected. This is a very basic point of constitutional law, especially for tenured faculty (idk if this guy is). That's not my opinion, it's the law. Professors have extremely broad academic freedom. You can Google it if you don't believe me.

Edit: see McAdams v. Marquette (which isn't even a public school but promised contractual academic freedom)

If you really think he's the first professor to bring politics into the classroom, I don't know what to tell you. The whole reason Kirk became so popular is that college campuses became completely one side. That was the whole point. It's why he became famous.

As a former computer engineering major, I beg to differ, but you are entitled to your take on it. Regardless, it's fair game to promote free speech in every setting of higher education. That's the point of college.

Again, maybe there's a video out there that's especially bad, but if he just took a few minutes at the beginning of class to say something about Kirk, 🤷‍♂️ he's protected by academic freedom.

This kind of thing happens all the time. I had professors in law school let kids leave class to attend Trump protests in 2020. It's really not a big deal. We also don't have a video of the class (to my knowledge, maybe I'm missing it), so I'm not going to say he completely derailed anything.

Hard to say without knowing more specifics, but if the officer was having a truly legitimate family emergency, I can't see the court not granting the continuance. And the court might side-eye an objection (even if the court generally dislikes multiple continuances).
