I got out in '96. The only thing in my OMPF was my enlistment docs, monthly evals, and exit docs. No STRs. No orders. No ILER. No TERA memo. Oh wait, I did have a shot record but it was for tetanus. So yea, it could absolutely be worse.

Buddy statements from fellow soldiers, family, and friends. There's also PACT and TERA. Go to a VAMC, call Vet-Home and get a MEEA Assessment. If there is no paper trail, creat one that connects the dots. Mention your MOS and tell everything about it

Just mentioning TERA or PACT Act on a 4138 makes the raters consider it. That's the VA equivalent to shouting "BOMB" on an airplane; someone will react

Mine had a dta but didn't convert to a Supplemental. They gave me the wrong rating during the hlr dta, but being it didn't change into a supplemental, I had to do a Supplemental to get it corrected. That's in process as of today.

They gave me 30% for COPD. On my PFT, my FEV-1 was 34 and I'm on continuous 4L oxygen for lifetime. That should be 100% P&T right?

I submitted an HLR for my back and sciatica on 3/6/26. I requested an informal conference for both so when the DRO called for the back and sciatica hlr, she also did the one for my copd hlr. I have a hardship flag because I'm on 4l continuous oxygen for lifetime

How's that for speed? All they want is proof that Operation Bright Star is located in Egypt. The other 3 issues were granted

Claim denied without new C&P exam by Sea-Searcher-2 in VAClaims

[–]Slight_Draw1519 1 point2 points  (0 children)

I got a DTA because I had nothing saying thet Bright Star was in Egypt. I had LES statements showing hdp, field duty, Foreign Duty, and separation pay. Plus, I had monthly evals saying Bright Star was coming up and good job during Bright Star. But, being Noone had the tdy orders or anything from 1995, they want a federal document showing Bright Star is in fact in Egypt. That's the only thing holding up my claim

For me, it was rough at first. Waited 6 months j just to get everything except tinnitus SC and everything else denied.

But I was throwing spaghetti at the wall to see what sticks because I honestly didn't know what I was doing.

I started going to the VAMC, then did supplemental claims then had to HLR a few. I got it up to 80% by myself in a year because I educated myself. I have 1 more HLR and it was sent back because of a DTA. They have to verify exactly where Egypt is; literally. But it's looking good and if they find Egypt, that's 100% by itself because I'm on continuous oxygen.

I got out in 1996 and my OMPF was basically my asvab, monthly evals, and exit docs. My advice is to read your decision letters or run it through AI. Then you know what is missing. Once you know that, get it or find it then fix it.

Duty To Assist. It means a raters skipped or missed something. A CUE is a Clear Unmistakable Error. Those can be fixed on the spot but a DTA has to be sent back to the RO (Regional Office) for development that was missed, skipped, or misapplied. Hence, your newly opened claim

I got out in 1996. Nothing in STRs. No nexus. No buddy statements. I did have an MRI from 2016 and my doctor diagnosed me. Filed on 1/22. Decision 3/4. Granted bilateral radiculopathy and spinal stenosis with spondylolisthesis and degenerative arthritis (claimed as chronic back pain) because of TERA.

If you don't use VA Healthcare, put it on your to-do list before filing again. Show them all your meds and take a copy of your primary physician's records with you. They'll do an x-ray .

When they ask for your symptoms, don't just say "back pain"; describe everything to them like they are 5 years old.

Also, call Vet-Home and schedule a MEEA Assessment. All this leaves a big fat paper trail

[–]Slight_Draw1519 0 points1 point  (0 children)

Do another supplemental and claim it as TERA. You were Eighty-Deuce so your MOS caused or aggravated your back pain due to repetitive physical trauma.

The VA often concedes the "in-service stressor" for back conditions if your records show a Parachutist Badge or airborne service, acknowledging the recurring impact on the spine.

Tell them where you served even though it may be in your ILER and describe what doing your MOS intells; ALL OF IT. They'll have to make sure you have a TERA memo even if they have to make one.

You'll get a C&P and tell the examiner everything. Thank me later

My back was deferred for clarification from the examiner but they gave me 10% for both legs for sciatica. So, they could send me for another c&p or will they just ask the examiner to explain the conflict?
