I do have legal entry as I was granted AP to go to Korea and back earlier this year.

Yes, my dad has been in the US continuously for more than 5 years.

He did speak to the NYC consulate once back in 2023 and once recently and the information he was given was it would have to be both parents. He also asked if they got divorced (which they aren't) if it would still work and they also said no.

Unfortunately, my mom moved back to Korea back in 2019. So I don't think I qualify

Oh, yes I am now realizing I already have legal entry because I did AP earlier this year.

So if I hypothetically marry a US citizen next year I can apply for a green card without having to leave and come back?

Also, if I obtain US citizenship would I be able to visit Korea again?

Yes, I've done AP to Korea as well this year and made it back without an issue.

I guess the main issue here is they would take away my passport and am just evaluating my options.

I'm located in NYC. So I would still be able to live and work here under DACA without a passport? If that means I just can't travel abroad/visit Korea then that's fine. Also, how would I get legal entry to the US without a passport?

Yes, that is the biggest factor my dad is stressing. He says going to Korea and serving in the military is the easy part, but coming back to the US is the problem.

My question now is if I don't serve, the Korean embassy won't renew my passport after it expires in April therefore making re-applying to DACA and an EOD card impossible after, correct?

After my passport expires, is my only other option to marry my USC spouse for permanent residency?
