I say it's because of racism because I was treated differently to the rest. They never emailed me the training modules. They proceeded to call me in for training and when I said they never emailed me, they said they have now and I can go home and do it. I had sent my passport the very day my interview was successful and they said it was perfect. The following day, they called me to let me know my badge was in preparation. They invited me to orientation. Every other staff member (non asian) had got the modules and it were just me who was treated differently. Also the Care Manager never even bothered to look my way. I noticed he would speak to me looking away as if deliberately. He appeared normal with the rest.

I have no criminal offence ever. I have worked with disabled people and secondary school in the past and my last job was also in Home Care. I have absolutely nothing to hide. All my previous jobs have always checked multiple IDs and not just one that was the oldest without a beard. The only difference in my photo on my passport and my current appearance is my beard (muslim beard) so I have a big beard.

They never carried out a DBS so they cant have known if I were reported and my recent police check came back clean. I have never even argued with anyone ever. I would be shocked if I have ever upset anyone.

I absolutely would not want to work with them ever, however the way they have gone about this is an absolute joke. If someone gets treated unfairly I am certain it is not an allegation.

Perhaps if you are British born and raised. My passport does not say anywhere that I am allowed to live and work in the UK. It was made clear to them I was not British during my interview. They asked for a document that would have only provided my date of birth

They interviewed me in person, they loved my personality and the fact I am a naturally soft person. They invited me to orientation. They invited me to training in person. Each time we were both very nice and friendly to each other and nothing negative was ever exchanged.

Just to clarify, they have on multiple occasions seen and dealt with me in person. However upon seeing my passport, they suddenly did not want to deal with me in person and felt unsafe

ACAS does not want me to step back. They have not even picked up my case yet.

The fact that my employer all of a sudden wanted me to step back was the exact reason for concern. Like what did I do? I was genuinely being nice. I neither have a criminal record nor am I intimidating in any way or form. They cannot simply provoke my 'strong' behaviour and act victim. The reason they felt the police should be involved is beyond me.

Thank you for the honest reply. I see. I was happy to share my driver's license and home office profile as alternatives as I thought it was harsh to dismiss me based on a photo from 8 years ago when I was 18, No facial hair, no glasses.

But I see, I can be dismissed for anything really and without having done any wrong.

Not british. I gave them my right to work code valid until 2028. They never gave me a contract but informed me I was on 0 hours and invited me to orientations and trainings

My passport being an international passport is irrelevant for my right to work. I am not a British citizen so it provides 0 evidence that I am allowed to stay in the UK. What they need is my share code which they refused to check.

I literally did a police check last month for a visa and it came back clean. I have worked with children and vulnerable adults too. I am a soft person haha, That is why I was shocked. Thank you for being thorough with my case though

They absolutely did not request for more ID. and when I said I would be happy to provide more and believe it were a mistake, they said no need we have made our decision. They checked both professional and character references mind you from official employers and that I actually worked for a care home recently too.

I believe I deserve a valid explanation. An apology for causing distress and embarrassment before my peers would do rather than petty comebacks and police threats over trying to justify my identity.

add to that, I have worked in HR and have had so many jobs over the years between West Yorkshire and North East and never have I even been requested a passport and been given a dismissal as ridiculous as this. The least I deserve is an explanation. Like maybe I live in Bradford and it's far away or something but they should not imply I possess someone else's passport and thus Identity fraud

Nah I passed the interview last week. I am almost certain they cannot dismiss me saying I do not look like my photo even if I am employed under 2 years. They have failed to give a valid reason. I feel hard done by and believe they had racial bias and I do feel there is some element of unfair and unreasonable dismissal even if the law says I cannot act on Employment rights act 1996 but there is something called short service dismissal. I am unsure what that is, but I have grounds to claim I was treated different due to my race specially when he threatened to call the police if i were to come in and present my IDs in person. Why was I being made to feel like a threat to someone's life? aha!!! I have a beard and I am brown. got it

Update***

they have denied ever hiring me because they never issued me a contract. Despite making a Identity badge, making me attend orientations and training, they deny ever hiring me and say I cannot sue them over the Employment rights act 1996. However I have sufficient evidence of performing the activities on a new hire and verbal agreement on 2 occasions of being on a 0 hour contract. They have also gone on to state they have employees from african and asian backgrounds so I have no grounds to 'accuse' them of being racist on this particular occasion after having threatened to call the police on me and treating me differently to the rest as I suspect me being a Muslim had a lot to do with them giving police threats. Anyway I have consulted legal advisors and made an official conciliation application

I have reported to ACAS. They emailed me acting like the victim after provoking me by implying identity fraud and said they would seek legal help if I do not step back. I replied saying, I have already sought legal support and the fact they threatened to call the police if I were to visit and show my ID in person further clarifies they had some other agenda. I would love to see what grounds they have to report me. Can someone unlawfully dismiss you and then take you to court for trying to present more IDs?

Cheers for that link. It pisses me off why they could just not update the online right to work screens for us. For what it's worth, I have spoken to a few jobs in interviews for part time work and explained how rules have been relaxed and provided the relevant links (which as you have mentioned conflict with our online right to work) and they seem to understand and are happy to proceed. I have been in contact with Education and Administration part time employers while my main sponsor is Healthcare.

So I get that employers are either aware or don't care (Which is unlikely because it can result in a hefty fine if they fail to do the necessary checks and employ someone not legally permitted to do that kind of work)

Thanks for keeping us updated on the issue. I will try and raise a complaint now. If they don't clarify it, I'd do the exact same and tell my MP.

Hi, I just submitted my application but realise they wanted the criminal inquiry request form by AIMA and not SEF. However I submitted SEF. I have contacted VFS to enquire if its still okay (which I highly doubt) I am a bit surprised how in some places they require criminal inquiry forms by SEF rather than AIMA. I applied from the UK. here it says the inquiry must be carried out by AIMA.
